A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN
OF THE CITY OF POWAY COMPREHENSIVE PLAN (GPA/ZC 86-02A)
WHEREAS, the City Council of the City of Poway recognizes that
the need may arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government
Code describes the procedures for amending General Plans; and
WHEREAS, property owners Anthony J. Aviano and CF Poway Ltd.
have filed a joint application, GPA 86-02A, requesting a modifica-
tion of land use designation on assessor parcels 317-232-6, 8, 9
and a portion of 5, having a total area of approximately 3.50 acres
and located at the northeast and northwest corners of the future
intersection of Pomerado and North Loop Roads; and
WHEREAS, the application requests a change in land use from
Residential Single-Family 2 (1-2 du/net acre) to Residential
Apartment (12-20 du/net acre) and Open Space; and
WHEREAS, the City of Poway held a properly noticed public
hearing on September 16, 1986 in accordance with the California
Government Code and the California Environmental Quality Act to
consider that request, and said hearing was continued to September
30, 1986; and
WHEREAS, the City Council determined during said public hearing
that a 0.29-acre parcel located immediately west of the applicant's
property, and owned by George McRae (APN: 317-232-10), shall be
included in the amendment area for Residential Apartment land use
to preclude its isolation as a single RS-2 designated parcel; and
WHEREAS, the City Council finds that proposed General Plan
Amendment 86-02A will not result in any significant adverse impacts
on the environment and hearby issues a Negative Declaration in
accordance with the Law and Guidelines of the California
Environmental Quality Act.
NOW, THEREFORE, BE IT RESOLVED that the City Council does
hereby amend the City of Poway General Plan Land Use Map of the
Land Use Element for the above described properties from
Residential Single-Family 2 (1-2 du/net acre) to Residential
Apartment (12-20 du/net acre) and Open Space.
