A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE ELEMENT OF
THE GENERAL PLAN OF THE CITY OF POWAY
COMPREHENSIVE PLAN (GPA 86-02F)
WHEREAS, the City Council of the City of Poway recognizes that
the need may arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government
Code describes the procedures for amending General Plans; and
WHEREAS, the City Council of the City of Poway directed a
review of the split-zoning and General Plan status of a parcel
having an area of approximately 1.73 acres and located on the south
side of Twin Peaks Road, at the southerly terminus of Budwin Lane
(APN 314-690-06); and
WHEREAS, the City of Poway held a properly noticed public
hearing on September 16, 1986, in accordance with the California
Government Code and the california Environmental Quality Act to
consider that request, and said public hearing was continued to
September 30, 1986; and
WHEREAS, the City Council finds that the subject parcel, which
is currently designated Residential Single Family 4 and Rural
Residential C, is substantially within the 100 year floodplain of
Rattlesnake Creek and the southerly portion of said parcel is
covered by the floodway of the subject creek; and
WHEREAS, the City Council further finds that the existence of
the floodplain and floodway precludes the further division of the
subject parcel in accordance with city policies; and
WHEREAS, the City Council has determined that this General Plan
Amendment will not result in any significant adverse environmental
impacts and issues a Negative Declaration.
NOW, THEREFORE, BE IT RESOLVED that the City Council does
hereby amend the City of Poway General Plan Land Use Map of the
Land Use Element for the above-described parcel from Residential
Single Family 4 and Rural Residential C to Rural Residential C.
PASSED and ADOPTED by the City Council of the City of Poway,
State of California, this 30th day of/September, 1986.
