A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA ORDERING THE SUMMARY VACATION OF LOT D AND ALL
ABUTTERS RIGHTS OF ACCESS APPURTENANT TO LOT D IN AND TO
DONART DRIVE, ALL AS DEDICATED BY BELVEDERE ESTATES, UNIT NO. 1
WHEREAS, an offer of dedication for Lot D of Belvedere Estates
Unit No. 1 and the relinquishment and waiver of all abutters rights
of access appurtenant to Lot D in and to Donart Drive was dedicated
to the public on November 19, 1958 on Map No. 4015 recorded as
Document No. 194049 of the official records of the County of
San Diego; and
WHEREAS, the City Council of the City of Poway desires to
summarily vacate said street and public service easement and to
return all abutters rights of access appurtenant to said Lot D, and
WHEREAS, the easement has been superseded by relocation and
there are no other public facilities located within the easement; and
WHEREAS, pursuant to the provisions of Chapter 4, Articles 1 & 2
of the Streets and Highways Code, the legislative body may vacate a
street, highway, or public service easement by adopting a resolution
of vacation.
NOW, THEREFORE, BE IT RESOLVED, that:

From and after the date this resolution is recorded,
Lot D of Belvedere Estates, Unit No. 1 and all abutters
rights of access appurtenant to Lot D in and to
Donart Drive as shown on Map No. 4015, recorded as
Document No. 194049 of the official records of the
County of San Diego, no longer constitute a street,
highway, or public service easement.
The City Clerk shall cause a certified copy of this
resolution of vacation to be recorded in the Office
of the Recorder of the County of San Diego.
PASSED, ADOPTED, AND APPROVED by the City Council of the City
of Poway, California at a regular meeting thereof this 9th day of
December, 1986.
