Res 86-135I~SOLUTION NO. 86-135 A ~OLUTIGN CF THE CITY COUNCIL CF THE CITY OF POWAY, CALIFOI~NIA, ESTABLISHING PR~3,:!~JRAL ~3LW.q TO CC~PLY WITH ~ COPE S~CTIONS 54954.2 AND 54954.3 ~EAS, except as provided therein, California Government Code Sections 54954.2 and 54954.3, effective jan,~ary 1, 1987, establish limitations upon discussing, and prohibit taking action upon items of business introduced at City Council meetings but not appearing on the agenda; and ~IEREAS, the City Council wishes to ccmply with both the spirit and the letter of said sections and to be as responsive to m~m~ers of the public as possible; and WHEREAS, the City Attorney has opined that, except as provided in said sections, the City Council should neither discuss nor act upon off-agenda items initiated by s~aff or Councilm~mbers; and ~{F~AS, the City Attorney has opined t_hat said sections do not prohibit discussion of off-agenda items introduced by the public provided that no action is taken. NOW, THEREFORE, THE CITY COUNCIL CF THE CITY OF PG~AY, CALIFORNIA, DOES HEREBY ADOPT ~ FOLLOWING lqUT,'~"~ OF PR0C~3GRE GOVF~ING ITS M~TINGS CC~94ENCING JANUARY 1, 1987: Section 1. Items of business not ap~ring on a City Council agenda and introduced by a Counci~ or by staff shall be referred automatically and without any discussion or action whatever by Council to the City Manager (1) for action by the City Manager if the matter is administrative in nature; or (2) for placement upon a City Council agenda within four (4) ~c~ks if the matter requires action by the Council. The City Manager shall report to the City Council within four (4) weeks any administrative action taken. Nothing herein shall prohibit or limit any Counci~ frc~ announcing or introducing at a m~cting of the Council any matter of concern to such Counci~. Section 2. Items of business not appea_ ring on a City Council agenda and introduced by a m~mber of the public may be discussed by the City Council, but no action shall be taken thereon. All such items sb~ll be referred autcmati- cally and without any action whatever to the City Manager (1) for action by the City Manager if the matter is administrative in nature; or (2) for placement upon a City Council agenda within four (4) weeks if the matter requires action by the Council. The City Manager shall report to the City Council within four (4) weeks' any administrative action ~__ken.
