THAT THERE ARE NO OIMER REASONABLE b~qANS OF
~{EREAS, The Poway Redevelopment Agency is authorized to carry out the
redevelolmlent of the Poway RedeveloimL~_nt Project Area; and
WHEREAS, the RedeveloimL~nt plan for the project area authorizes and
directs the Agency to acquire property for public purposes which are enumerated
in ~aterials referenced in the Redevelopment Plan and which include the acquisi-
tion of a parksite; and
~J{EAS, the Pow~y I~develoim,~nt Agency will undertake the acquisition
of a 4.77 acre parksite generally bounded by Midland Road, Aubrey Strut,
Sycamore Street, and T~nple Street; and
I~REAS, this parksite is within the Paguay l~develolxnent Project and
the acquisition is necessary the execution of the Project under the provisions
of the California C~i,%onity R~teveloImnent Law (Health and Safety Code, Section
33000 et seq.) and purs,,~nt to the Redevelolm~ent Plan for the Project, which
R~tevelounent P]~n wss adopted en Dec6mber 13, 1983, by Ordinance No. 117 of the
City Council; and
IAE~JRFJ%S, Section 33445 of the California Health and Safety Code
requires the A~3ency to determine the issue of benefit to the Paguay
R~evelolm~ent Project prior to the acquisition of the parksite and that no other
r~mom_mhle tm=runs of financing are available.
NOW, T~R. REFORE, ME IT RESOLVED that the City Council of the City of
Poway does hereby resolve as follows:
Section 1. The City Council hereby determines that the acquisition of a 4.77
acre park. site generally bounded by Midland Road, Aubrey Street, Sycamore Street,
and T~le Street is of benefit to the Paguay Redevelolmnent Project by providing
park, recreational and open space for the surrounding c~%%%0nity and the project
area in general.
Section 2. The City Council further determines that no other reasoDahle
of financing the improvements are available to the ccmm~nity.
Section 3. The City Clerk shall certify to the adoption of this resolution.
