A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF POWAY, CALIFORNIA, DECLARING
THE INTENTION TO LEVY AND COLLECT
ASSESSMENTS WITHIN THE POWAY CITY
LIGHTING DISTRICT FOR FISCAL
YEAR 1987-88
WHEREAS, the City Council of the City of Poway, California
desires to levy and collect assessments within the Poway City
Lighting District for the purpose of maintaining, servicing
and operating public lighting facilities in the City of Poway
as shown in the attached Exhibit A, pursuant to the Streets
and Highways Code; and
WHEREAS, the public interest and convenience requires the
maintenance, service and operation of the public lighting
facilities within the City of Poway.
NOW THEREFORE, the City Council of the City of Poway
does hereby resolve as follows:
1. The foregoing recitals are true and correct and
the City Council so finds and determines.
2. Proposed assessments for 1987-88 are as detailed in
the Engineer's Report for Poway City Lighting District
for the fiscal year 1987-88, Exhibit B.
3. Pursuant to the Streets and Highways Code, a public
hearing will be held on June 2, 1987 in the City
Council Chambers at City Hall to consider the levy
and collection of the proposed assessments.
PASSED, ADOPTED, AND APPROVED at a regular meeting this
12thday of May, 1987.

PURPOSE
The purpose of this report is to present findings and the
~ngineering analysis for the Poway City Street Lighting District
for the 1987-88 fiscsl y~r. This Lighting District, utilizing
direct benefit assessments, finances the cost of providing
mintenance and operation of public street lighting facilities
within the City. The District contains all the territory within
the boundaries of the City of Poway.
FINDINGS
The City Ommcil of the City of Poway om May 12, 1986, initially
formed the Poway City Street Lighting District and confirmed
assessmlents for the first fiscal ymmr, 1986-87.
This report covers the levy of the annual assessments for the
1987-88 fisom3 y~r and provides for annexations of additional
City area into the Lighting District. There are no properties to
be annexed into the District for the 1987-88 fiscml y~r.
The public street lighting syst~n in the Lighting District is
both SDG&E-owned and City-owned and will consist of approximately
1,543 lights, as shown below:

Part 2 of Division 15 of the Streets and Highways Gode, the
Landscaping and Lighting Act of 1972, permits the establishment
of Assessment Districts by cities for the purpose of providing
certain public improvem~ts which include mintenance and
operation of str~ lights.
The 1972 Act requires that maintenance assessments be levied
according to benefit rather than according to assessed value.
Section 22573 provides that:
The net ~m%ount to be assessed upon lands within an
assessment district may be apportioned by any form,,]~
or method which fairly distributes the net amount along
all assessable lots or parcels in proportion to the
estimated benefit to be received by each such lot or
parcel frc~a the improve~?_nts.
The Act also permits the designation of zones of benefit within
any individual assessment district if "by r~ons of variations
in the nature, location, and extent of the improv~nents, the
various ar~-~ will receive different degrees of benefit frsm the
improvement" (S & H S22574) Thus, the 1972 Act requires the
levy of a true "assessment" rather than a "special tax."
The 1972 Act provides that the total cost Mn be recovered in the
assessment spread incl,~4{ng incidental expenses. The latter Gan
include engineering fees, legal fees, printing, mailing, postage,
publishing and all other costs identified with the district
proceedings. The 1987-88 fiscal y~r expenditures for street
lighting are estimated as follows:

Name
The District is entitled "Poway City Lighting District."
The boundaries of the proposed assessment district are as shown
on the Assessment Diagram. (See Attachment A. )
A31 parcels identified in the latest San Diego Gounty Assessor's
Parcel Maps within the City, are included in the District
excerpting frc~ the assessment of said oosts and expenses within
the area desribed, the area of public roadways, alleys, green-
belts, and parkways and property being used for public purposes.
The property lines and dimensions of each lot or parcel of land
within the Lighting District is shown in detail on the G~unty of
San Diego Assessor' s maps, on file in the Gounty Assessor' s
office, 1600 Pacific Highway, Rocml 103, San Diego, G~ 92101.

and the methodology used fairly distributes the cost of the
system in r~ltion to the benefits received.
There are approximately 11,700 parcels of property in the
District, and two benefit zones for assessment Durposes are
established as follows:
Those parcels that are directly serviced by public
street lights or by lights in the in~ediate vicinity
and therefore recieve direct benefit.
Those parcels that do not receive direct benefit due to
the absence of public street lights in the inm~diate
vicinity of the parcel.
The benefits of street lighting accrue as c~unity benefits and
as individual or service benefits. C~L,L~nity benefits are
~efined as those o~,.,on to all persons holding and/or using real
property as they use public streets and pedestrian ways for
access throughout the lighted ar~ of the City of Poway.
Indivic%,~l or service benefits, are defined as those particular
to a person holding and/or using a r~l property parcel that is
directly serviced by street lighting at, or in the ~,,~,~diate
vicinity of the parcel. Therefore, those parcels in Zone A are
assessed for both c~L,~nity benefits and individual benefits
wher~s those ?_rcels in Zone B are assessed only a ~uL.~unity
benefit.
The methodology for the benefit assessment for the Poway Street
Lighting District is ~onsistent with the benefit structure
currently applied to those aree_~ of the City of Poway now
serviced under the (/~nty of San Diego Street Lighting District
This structure is based en the determination that the benefits of
street lighting for each real property parcel are a function of
the traffic generated by the use of that parcel. P.~nefit units
are then calculated for each parcel using a benefit factor
~lerived frem the land use/traffic generation functions.

Derivation of Benefit Factor
Benefit factors have b~-~n determined for all land use cmtegories
as defined in Attad,,,',ent B. A benefit factor of 1.0 is assigned
to single family residential !and use. Benefit factors for all
other land use c~tegories ere then derived in proportion to land
use/traffic generation as um~-~ared to the single family
residential traffic generation rate of 10.1 trips per dwelling
unit, or 36.4 trips per acre. Traffic generation rates by l~nd
use are as prepared by the San Diego Association of Goverrm~=-nts
and (IALTRANS, District 11, based on trip generation st,~a~es done
in the San Diego region and are presently being used by the
(bunt Lighting District to cmlculate these assessments.
The derivation of benefit factors for all land use categories
other than single family residential follows. All factors above
0.5 are rounded to the n~rest whole number.

C~lculation of Benefit units
Benefit factors are extended to benefit units for assessment by
multiplying the benefit factor by the number of dwelling units
per parcel or the acreage of the parcel as appropriate. This
base calculation is appli~hle to all parcels that accrue both
u~f,¥Lunity benefits and service benefits, as previously defined.
ApPromtmately one-third of all parcels in the City of Poway do
not, however, receive service benefits. An adjustment in base
benefit units, then must be made to reflect c~.t~unity benefits
only. For this purpose, it is assumed that one-fourth of total
benefits accrue as cu~%unity benefits and three-fourths accrue as
service benefits. Therefore, a c~'.L~nity benefit of 0.25 is
applied to the benefit factors for all developed parcels not
directly serviced by street lighting. The adjusted benefit
factors then are extended as noted above. Vacant parcels are not
assessed.
Using current available data frcm the San Diego ODunty Assessor,
an estimate of aggregate benefit units by land use type has bccn
u~.~uted using the described method. These estimates are
~hulated in Attad.,~-~ent D.
Based upon the previous discussion, it is proposed in FY 1987-88,
that the base benefit charge be $15.00. Thus, for u~-,unity
benefits, $3.75 will be charged and for service benefits, $11.25.
In s~,,ery, those parcels in Zone A will be assessed $15.00 per
benefit unit and those parcels in Zone B will be assessed $3.75
per benefit unit.

Scope of Work
San Diego C-~.~ & Electric (SDG&E) sb~all be the supplier of
electrical energy for all the above listed street lights as well
as providing needed maintenance and replacenents for those street
lights owned by SDG&E.
The City of Poway shall provide ~mint~w~nce and replacenent needs
for those City-owned street lights.
Oosts for electrical energy charges and maintenance of SDG&E-
owned street lights shall be billed to the City by SDG&E. The
City shall disburse payments to SDG&E fr~n a City account
es~mhlished for the Poway City Lighting District. O0sts incurred
by the City in maintaining City-owned street leights sb~ll be
paid frcm the account. Oosts incurred by the City for:
Administration; engineering; operations and other related
requirenents shall be paid frc~n the account.
