N~W T~mm~C~E, the City Council of the City of Poway does hereby resolve as follows: 1. The foregoing recitals are true and correct and the City Council so finds and determines. Proposed assessments for 1987-88 are as detailed in the Engineer's Report for Poway Tmndscape Maintenance Assessm%ent District No. 86-1 for fiscal y~r 1987-88, Exhibit B. Pursuant to the Streets and Highways Cede, a public hearing will be held on June 2, 1987 in the City Council Chambers at City Hall to consider the levy and collection of the proposed assessments. The Assessment District was formed June 12, 1986 as a me~__ns of financing the maintenance of landscape improvements installed in conjunction with new sub- divisions in Pow-ay, the boundary being as shown in Exhibit A. FINDINGS The Landscape and Lighting ACt of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improv~ents which includes the facilities existing within the subject assessment district. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: "The net ~ount to be assessed upon l~nds within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel frc~a the improvenents." Based upon the foregoing, it is proposed the City of Poway generate the necessary revenue required to maintain the aforementioned land- scaping improvenents within Landscape Maintenance Assessment District No. 86-1 for the 1987-88 fiscal y~r using the method provided for in the Iandscape and Lighting Act of 1972. ~GINRR. RING ANALYSIS B~md~y The bouDaary of the proposed assessment district is as shown in Emhibit A with City of Poway Tract~ 4090R, 4091R, 4092R, 4093R and 3545, being the present full extent of the district (493 lots). Exceptions frcm the assessment of said costs and expenses within the area described, are ar~.~ of all public streets, public avenues, public lanes, public roads, public drives, public courts, Dublic alleys, all ~.~enents and rights of ~y, all public perks, greenbelts and parkways, and all public school property being used for public school purposes. The name of the district is "Poway T~ndscape M~{ntenance Assessment District NO. 86-1." FACILITIES The facilities to be maintained are defined as the landscaping and soundwalls within the right of ~ay adjacent to Espola Road; the recreational trails and sidewalks, greenbelts and open space cerridors within the District boundaries. EXISTING (I~DITIONS OF IANDSCAPE MAINTENANfE WITH DEVelOPED SUBDIVISIONS OF DISTRICT Each of the respective subdivisions in the district has been inven- toried and evaluated to insure cc~pliance with required improvenents. Landscape maintenance and performance standards and specifications have been developed to assure a continuing level of consistency and quality to landscape care of assessment district properties. mRNEFIT ANALYSIS The District enc~¥~sses five tract developments along the Espola l%oad corridor. Four of these, 4090R, 4091R, 4092R, and 4093R (Hirsch Ranch) have mjor la~4mcape improvements fronting the Espola Road right-of-way and c~e, ~3545 (Piedmont Park) ham limited public impro- v~.ents. City of Poway ~1~ 3545 will therefore, be assessed separately frcm ~M's 4090R through 4093R. Tract 3545 ham a total of 78 lots, and tracts 4090R through 4093R have an aggregate of 415 lots.
