Res 87-046~ESOLUTIONNO. 87-046 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, E~CIARING ~6E I~I'~4TION TO LEVY AND COr,r.RCT ASSESSMENTS WITHIN THE POWAY LANK~CAPE MAINTENANCE ASSESSM~qT DISTRICT NO. 86-2 FOR FISCAL YEAR 1987-88 $~.-m~S, the City Council of the City of Poway, California desires to levy and collect assessments within Poway Landscape M~ntenance Assessment District No. 86-2 for the purpose of main- taining, servicing and operating public l~ndscape facilities located within the territory c~mprising of said district as shown in Exhibit A, pursuant to the Landscaping and Lighting Act of 1972; and ~EAS, the public interest and convenience requires the main- tenance, service and operation of the public landscaping, sound- ~lls, recreational trails, and future parks within said territory. Proposed assessments for 1987-88 are as detailed in the Engineer's Report" for Pow-ay Landscape MainteD~ance Assessment District No. 86-2 for fiscal y~r 1987-88, Exhibit B. Pursuant to the Streets and Highways Code, a public h~aring will be held on June 2, 1987 in the City Council Chambers at City ~11 to consider the levy and collection of the proposed assessments. Marjorie K; Wahlsten, City Clerk EXHIBIT A LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 86-2 Boundary Map: Sunrise Ranch - Tract 4185R EXHIBIT B PONAY IAbDS~ MAINT~%%N(E ASSESSMENT DISTRICT NO. 86-2 FOR 1987-88 FIS(I~L YEAR PURPOSE The purpose of this report is to set forth findings and engineering analysis for Poway I~ndscape Maintem~nce Asses~nent District No. 86-2 for 1987-88 fiscal ymar. The Assessment District was formed_ May 20, 1986 as a me~___ns of financing the maintenance of ]mndscape improvements installed in conjunction with new sub- divisions in Poway, the boundary being as shown in Exhibit A. The Tmndscape and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improv~nents which include the facilities existing within the subject assessment district. The 1972 Act requires that mintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: "The net amount to be assessed upon lmnds within an assesmnent district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel frGn the improvements." Based upon the foregoing, it is proposed the City of Poway generate the necessary revenue required to maintain the aforementioned land- scaping improvements within Landseape Maintenance Assessment District No. 86-2 for the 1987-88 fis~] y_~__r using the method provided for in the Landscmpe and Lighting Act of 1972. ~GINRE~RING ANALYSIS Boundmry The boundmry of the proposed assessment district is as shown in Exhibit A with City of Poway Tract 4185R being the present full extent of the district ( 35 lots). Exceptions frcm the assessment of said costs and expenses within the area described, and the area of all public streets, public avenues, public lanes, public roads, public drives, public courts, public alleys, all easements and rights of way, all public parks, greenbelts and parkways, and all public school property being used for public school purposes. The name of the district is: "Poway Iandscape Maintenance Assessment District No. 86-2." FACILITT~ The facilities to be maintained are defined as the landsomping and soundwalls within the right of my and adjacent to Poway Road, the recreational trails and sidewalks, and grcc~nbelts within the District boum~ries. B~qEFIT ANALYSIS The District is made up of 35 residential lots in Sunrise Ranch, City of Poway Tract 4185R. The assessment will be cslculated on a per lot basis by dividing the total budget by 35. 1. Mngineering & Legal $ 500 2.
