J Pursuant to the Streets and Highways Code, a public b~ring will be held om June 2, 1987 in the City Council Chambers at City Fml 1 to consider the levy and collection of the proposed assessments. The Assessment District Ms formed June 14, 1983 as a m~ns of financing the maintenance of landscape improvements installed in oonjunction with new sub- divisions in Pow-ay, the boundary being as shown in Exhibit A. FINDINGS The I~x~sc~pe and Lighting Act of 1972 permits the es~m_hlishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvenents which include the facilities existing within the subject assessment district. The 1972 Act requires that maintenance assessments be levied according to benefit rather than acoording to estimated value. Section 22573 provides that: "The net ~nount to be assessed upon lands .within an assessment district may be apportioned by any formula or method which fairly distributes the net 8m~unt ~nong all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel fr~ml the improvements." Based upon the foregoing, it is proposed the City of Poway generate the necessary revenue required to maintain the afor~nentioned ]and- scaping improv~m~_nts with T~ndsc~pe Maintenance Assessment District No. 86-3 for the 1987-88 fiscal y~r using the method provided for in the Tmndscape and Lighting Act of 1972. Bcundary The boundary of the proposed assessment district is as shown in Exhibit A with Tract 3994 being the present full extent of the District with 30 lots. The name of the district is: "Poway Landscape Maintenance Assessment District No. 86-3." The facilities to be maintained are shown in the T~ndscape Maintenance District Improvement Plans and include landscaped ar~.~ adjacent to Pcmerado Road, Beeler Creek, a maintained pond, and trails, all within the District boundaries. B~qEFITANALYSIS The District is made up of 30 residential lots in Tract 3994. The assessment is calculated en a per lot basis by dividing the total budget by 30. 1. Engineering $ 400 2. Power 390 3.
