NOW ~P~FO~, the City Council of the City of Pow~y does hereby resolve as follows: 1. The foregoing recitals are true and correct and the City Council so finds and determines. Proposed assessments for 1987-88 are as detailed in the "Engineer's RF?ort" for Poway Landscape Maintenance Assessment District No. 87-1 for 1987-88 fiscal y~r, Attachment "A". 0 Pursuant to the Streets and Highways Code, a public h~ring will be held on June 2, 1987, in the City Council Chambers at City }~m] 1 to consider the levy and collection of the proposed assessments. Bruce Tar~y, Ma~ R/L-87-1 ATTACHMENT "A" ~GIN":":R' S REPORT FOR POWAY LANDSCAPE MAINT~qAN~ ASSESS~T DISTRIC~ ~0. 87-1 FOR 1987 - 1988 FISCAL YEAR PURPOSE The purpose of this Report is to set forth findings and e~gineering analysis for the Poway Landscape Maintenance Assessment District No. 87-1 for 1987-1988 fiscal y~r. The Assessment District was formed Jan~y 27, 1987 as a me~ns of financing the maintenance of landscape improvements installed in conjunction with the P~nerado Business Park, the boundary being as shown in Exhibit A. The Landscaping and Lighting Act of 1972 permits the es~blishnent of assessment districts by cities for the purpose of providing for the maintenance of certain public improvenents which includes the facilities existing within the subject assessment district. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 states: "The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net ~mount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements ." Facilities The facilities to be maintained are shown o~ the approved land- seaping plans for the project and are briefly described as follows: Roadway medians in Pcmerado ~Dad, South Poway Parkway, and fhlbb, unity Road; soundwalls, retaining walls, and adjacent parkways along Pcmerado Road; detention basins; equestrian trails and equestrian staging areas. The Landscaping plans are incorporated in the Report by reference. COst Estimate It is anticipated that no landscaping will be accepted for maintenance in fiscal y~__r 1987-1988. Therefore, the enly costs incurred will be for the Engineer's Report and related administrative services. The estimated expense for these is $2,000.00. Assessment Diagram The boundary of the proposed Assessment District and the individual percels are shown on Exhibit A. The following areas are excluded frcm assessments for the district: All public streets, public avenues, public lanes, public roads, public drives, public courts, public alleys, public right-of-ways, all public r_mrks, greenbelts and parkways, and all public school property used for public school purposes. Method of Assessment In order to provide an equitable assesament, 50% of the cost ~y distributed evenly over all the lots. The renaining 50% ~s then apportioned to the lots based om their net usable acreage. The calculations are shown in tabulated form on Exhibit B.
