A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
ORDERING THE SUMMARY VACATION OF A
SEWER EASEMENT LOCATED AT PIEDMONT PARK
TRACT NO. 3545, MAP NO. 10432
WHEREAS, the City Council has been requested to vacate a portion of property
located west of Poway High School, Lot 36, Tract 3545 which is no longer
required by the City of Poway for public use purposes; and
WHEREAS, said vacation is consistent with the general plan of the City of
Poway; and
WHEREAS, said property is not useful as a nonmotorized transportation
facility.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF POWAY AS
FOLLOWS:
The City Council finds that the portion of property hereinafter
described located Piedmont Park, west of Poway High School, Tract 3545,
and previously dedicated for sewer easement purposed, is found to be
unnecessary for present or future public use purposes. There are no
in-place public utility facilities that are in use or would be affected
by the vacation.
Therefore, the City Council hereby orders the summary vacation of the
property described in Exhibit "A", pursuant to the provisions of
Chapter 4 of the Public Streets, Highways, and Service Easements
Vacation Law, Section 8330 et seq. of the Streets and Highways Code of
the State of California.

All as more particularly shown on a map 10432 on file in the office of
the City Clerk of the City of Poway.
From and after the date this resolution is recorded, said property
herein vacated shall no longer constitute a sewer easement.
The City Clerk is directed to cause a certified copy of this resolution
to be recorded in the office of the County Recorder of San Diego
County.
PASSED, ADOPTED AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting thereof this 12th day of May, 1987.

EXHiBiT 'A'
That portion of Lot 36 of City of Poway Tract No. 3545, in the County of San
Diego, State of California, according to Map No. 10432, filed in the Office of
the County Recorder on July 15, lg82, being a 2D.DO foot strip of land lying
10.00 feet on each side of the following described centerline:
Beginning at the Northwest corner of said Lot 36 of City of Poway Tract No.
3545; thence southerly along the westerly property line of said lot, south
01 37' 34" east, 10.00 feet to the TRUE POINT OF BEGINNING,; thence north
88 22' 26" east, 116.29 feet to the beginning of a 200.00 foot radius curve
concave southwesterly, a radial line to said point bears north 01 37' 34"
west; thence southeasterly along the arc of said curve through a central
angle of 60 17' 18", 210.45 feet; thence north 88 54' 22" east, 10.00 feet
to a point on the easterly property line of said Lot 36, distant thereon
north 01° 37' 34" west 34.23 feet from the southeast corner of said Lot 36.
The sidelines of the above strip of land shall be shortened or lengthened so
as to terminate on the westerly and easterly lines of said Lot 36.
