A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
FOR THE COLLECTION OF SCHOOL FEES
ESTABLISHED BY THE POWAY UNIFIED SCHOOL DISTRICT
WHEREAS, Section 53080 of the California Government Code imposes
a state-mandated local program by prohibiting cities and counties
from issuing building permits without certification from the
appropriate school district governing board, that the development
is in compliance with any developer fee or dedication requirement
imposed by that district; and
WHEREAS, the Poway Unified School District Board adopted a
resolution levying fees pursuant to Section 53080 on January 5,
1987; and
WHEREAS, the Poway Unified School District adopted a resolution
requesting that the City of Poway collect development fees for the
district pursuant to Government Code Section 53080 on March 3,
1987; and
WHEREAS, it is the desire of the City Council of the City of
Poway to insure that all authorized school fees are collected for
use by the Poway Unified School District and that the collection of
these fees be made as convenient as possible for the builders of
residential, commercial, and industrial development.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Poway, does hereby direct its staff to collect the school
fees authorized by Section 53080 of the government code for the
Poway Unified School District through the office of the Director of
Planning Services, and that such fees be transferred to the school
district on a monthly basis.
PASSED, ADOPTED, and APPROVED by the City Council of the City
of Poway, State of California at a regular meeting thereof, this
9th day of June 1987.
