RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
RE- ESTABLISHING TWO MIDBLOCK CROSSWALKS ON TIERRA BONITA ROAD
BETWEEN POWAY VALLEY ROAD AND DONART DRIVE
WHEREAS, Section 21100 of the California. Vehicle Code permits local authorities
to adopt, by resolution, traffic control measures meeting the requirements set forth under
Section 21351 of the California Vehicle Code; and
WHEREAS, Section 21351 of the California Vehicle Code permits local authorities
to place and maintain such traffic devices upon streets and highways as may be necessary
to properly indicate and carry out the provisions of the local ordinances and to warn or
guide traffic; and
WHEREAS, Section 21106 of the California Vehicle Code permits local authorities
to establish crosswalks between intersections; and
WHEREAS, on June 3, 2003, the City Council adopted Ordinance 577 amending
Poway Municipal Code (PMC) Chapter 10.36 "Crosswalks" to add Sections 10.36.040
"Tierra Bonita Road Near Poway Valley Road" and 10.36.050 "Tierra Bonita Road Near
Donart Drive" to allow two midblock crosswalks on Tierra Bonita Road between Poway
Valley Road and Donart Drive; and
WHEREAS, the City Council is repealing PMC Chapter 10.36 in its entirety, but
desires to maintain the two midblock crosswalks on Tierra Bonita Road between Poway
Valley Road and Donart Drive.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1 : In accordance with said Section 21106 of the California Vehicle Code, two
midblock crosswalks with appropriate signing and marking are hereby re- established on
Tierra Bonita Road between Poway Valley Road and Donart Drive.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway at a
regular meeting this 20th day of December 2011. This resolution shall become effective on
the 3rd day of January 2012.
