AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
REPEALING POWAY MUNICIPAL CODE CHAPTER 10.36,
"CROSSWALKS" IN ITS ENTIRETY
WHEREAS, Section 21106 of the California Vehicle Code (CVC) gives local
municipalities the authority to establish crosswalks between intersections by Ordinance
or Resolution; and
WHEREAS, Part 3 "Markings" of the California Manual on Uniform Traffic Control
Devices ( MUTCD) outlines guidelines to establish a midblock marked crosswalks; and
WHEREAS, Chapter 10.36 of the Poway Municipal Code (PMC) provides the list
of approved midblock crosswalks in the City of Poway; and
WHEREAS, Chapter 10.36 necessitates an amendment to the PMC when a new
midblock crosswalk is established by the City Council; and
WHEREAS, a midblock crosswalk can be established by City Council Resolution
based on the California MUTCD guidelines.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
Section 1 : Chapter 10.36 "Crosswalks" of the Poway Municipal Code, consisting of
Sections 10.36.010 through 10.36.050, is hereby repealed in its entirety.
EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30)
days after its adoption.
CERTIFICATION /PUBLICATION: The City Clerk shall certify the adoption of this
Ordinance and cause it or a summary of it, to be published with the names of the City
Council members voting for and against the same in the Poway News Chieftain, a
newspaper of general circulation in the City of Poway within fifteen (15) days after its
adoption and shall post a certified copy of this Ordinance in the Office of the City Clerk
in accordance with Government Code § 36933.
Introduced and first read at a Regular Meeting of the City Council of the City of
Poway held the 20th day of December 2011, and thereafter PASSED AND ADOPTED
at a regular meeting of said City Council held the 3rd day of January 2012.
