A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
REPEALING RESOLUTION NO 86 -065
PERTAINING TO CANDIDATE'S STATEMENTS
SUBMITTED TO VOTERS AT MUNICIPAL ELECTIONS
WHEREAS, Section 13307 of the California Elections Code provides that any
candidate for nonpartisan elective office in any city may prepare a candidate's statement of
no more than 200 words, which statement may contain up to 400 words, if approved by the
City Council, and which statement is to be included in the voter's pamphlet sent to each
registered voter in the City; and
WHEREAS, Section 13307 further provides that the City may require each
candidate filing a statement to pay to the City, in advance, his or her estimated pro rata
share of the costs incurred by the City to include the statement as a condition of having his
or her statement included in the voter's pamphlet, and to pay the final actual cost of
printing the candidate's statement, once that charge is finally ascertained, and
WHEREAS, Poway City Council Resolution No 86 -065 provides that for every
municipal election held after June 10, 1986, each candidate electing to submit a
candidate's statement for printing in the voter pamphlet is required to pay in advance
$50 00, and does not provide that the candidates must be responsible for the actual cost of
printing the statement, once it is finally determined, and
WHEREAS, the City Council has determined that the costs of translating, printing
and distributing the candidate's statements in municipal elections has increased
considerably since 1986, thereby imposing a significant financial burden on the City, which
burden could be offset by eliminating the maximum cost for each candidate who chooses
to submit a candidate's statement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows
Section 1 Poway City Council Resolution No 86 -065 is hereby repealed
Section 2 On or before the seventh (7 day before the nominating period for
each municipal election in the City of Poway opens, the City Council, by resolution, shall
determine whether a charge shall be levied against each candidate who chooses to submit
a candidate's statement for translating, printing and distributing to the City voters by the
County elections official The City Clerk shall provide each candidate or the candidate's
representative with a copy of the resolution adopted by the City Council at the time he or
she picks up the nomination papers for that municipal election
