A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE ELEMENT OF
THE GENERAL PLAN OF THE CITY OF POWAY
COMPREHENSIVE PLAN (GPA 87-01)
WHEREAS, the City Council of the City of Poway recognizes that
the need may arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government
Code describes the procedures for amending General Plans; and
WHEREAS, the City Council of the City of Poway at their
adjourned regular meeting of February 5, 1987 initiated a general
plan amendment to change the land use designation for two adjoining
parcels of land located south of Poway Road, west of Carriage Road,
at the southern terminus of Silver Lake Drive; and
WHEREAS, the subject parcels are described as follows:
Assessor's Parcel No. 317-490-33 contains approximately 1.17 acres
of land owned by Ross Williams, et al, and is substantially unde-
veloped with the exception of two existing residential structures;
and Assessor's Parcel No. 317-490-46 contains approximately 2.86
acres of land owned by the Bank of San Diego and is presently unde-
veloped; and
WHEREAS, the proposed General Plan land use redesignations for
the subject parcels are described as follows:
1) APN: 317-490-33 (1.17 acres), is designated Residential
Condominium (7-12 du/net acre); and it is proposed that the south-
westerly portion of the subject parcel situated above the 500 foot
elevation contour line (approximately 0.36 acres) be redesignated
to Open Space and the balance of Parcel 33 below the 500 foot ele-
vation contour line remain under the Residential Condominium
designation; and
2) APN: 317-490-46 (2.86 acres) is designated Residential Apartment
(12-20 du/net acre); and it is proposed that the southeasterly por-
tion of the subject parcel situated above the 500 foot elevation
contour line (approximately 1.68 acres) be redesignated to Open
Space; the portion of the subject parcel situated below the 500
foot elevation contour line and east of the Silverlake Drive cul-
de-sac (approximately 0.14 acres) be redesignated to Residential
Condominium (7-12 du/net acre); and, the portion of the subject
parcel situated below the 500 foot elevation contour line and west
of the Silverlake Drive cul-de-sac (approximately 1.04 acres) be
redesignated to Residential Single Family 5 (4-7 du/net acre); and

WHEREAS, the City Council finds that the proposed land use
redesignations of the above described parcels is necessary in order
to preserve the physical and cultural integrity of the existing
topographic feature which comprises portions of the subject par-
cels situated above the 500 foot elevation contour line, and that
the land use redesignations will promote land use compatibility
with surrounding land uses and will also result in a higher degree
of environmental quality for the area; and
WHEREAS, the City of Poway City Council held a properly noticed
public hearing on April 21, 1987 in accordance with the California
Government Code and the California Environmental Quality Act to
consider the subject City-initiated General Plan Amendment, and
said public hearing was continued from time to time by the City
Council to the meeting of October 13, 1987; and
WHEREAS, the City Council finds that the proposed General Plan
Amendment 87-01 will not have a significant adverse impact on the
environment and hereby issues a Negative Declaration.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Poway does hereby amend the City of Poway General Plan Land
Use Map of the Land Use Element for the above described parcels as
follows: From Residential Condominium (7-12 du/net acre) to Open
Space for that portion of APN: 317-490-33 as fully described above;
and from Residential Apartment (12-20 du/net acre) to Open Space,
Residential Condominium (7-12 du/net acre), and Residential Single
Family 5 (4-7 du/net acre) for those portions of APN: 317-490-46 as
fully described above; and said land use redesignations for the
subject parcels are depicted on a map on file in the office of the
City Clerk.
APPROVED and ADOPTED by the city Council of the City of Poway,
State of California, this 13th day of October, 1987.
