Res 12-009RESOLUTION NO 12 -009 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, AS SUCCESSOR AGENCY TO THE POWAY REDEVELOPMENT AGENCY RATIFYING ADMINISTRATIVE APPROVAL OF THE PRELIMINARY DRAFT OF THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE WHEREAS, Assembly Bill X1 26 ( "AB 26 ") was passed by the State of California Legislature on June 15, 2011 and signed by the Governor on June 28, 2011, and WHEREAS, pursuant to the requirements of AB 26, on October 4, 2011 the former Poway Redevelopment Agency adopted Resolution R -11 -18 ratifying the administrative approval of the preliminary draft of the Recognized Obligation Payment Schedule (ROPS), and WHEREAS, on February 1, 2012 the City of Poway became the Successor Agency to the Poway Redevelopment Agency; and WHEREAS, the City of Poway as Successor Agency to the Poway Redevelopment Agency has since modified the ROPS and the City Manager, on behalf of the City, approved it administratively; and WHEREAS, the City of Poway as Successor Agency now desires to ratify the administrative approval of the ROPS by the City Manager NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as Successor Agency to the Poway Redevelopment Agency as follows Section 1 The City of Poway as Successor Agency to the Poway Redevelopment Agency finds and determines that the foregoing recitals are true and correct. Section 2 The City of Poway as Successor Agency to the Poway Redevelopment Agency hereby ratifies the City Manager's administrative approval of the ROPS in the form and content attached hereto as Exhibit "A" and incorporated herein by this reference, subject to any minor conforming, technical, or clarifying changes approved by the City Manager Section 3 In accordance with AB 26, the City of Poway as Successor Agency to the Poway Redevelopment Agency hereby authorizes the City Manager or designee to take such actions as are necessary and appropriate to comply with AB 26 Section 4 This Resolution shall take effect immediately upon its adoption Resolution No 12 -009 Page 2 PASSED, ADOPTED AND APPROVED by the City of Poway as SuccessorAgency to the Poway Redevelopment Agency at a regular meeting this 21 st day of February, 2012 f f W� Don Higginson, ATTEST aAl."Troyan, MMC, City Clerk STATE OF CALIFORNIA ) )SS COUNTY OF SAN DIEGO) I, Linda A.
