A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, CONCERNING THE FORGIVENESS OF
DEBT AS REQUIRED BY AB 936
WHEREAS, California State Assembly Bill 936 (AB 936) became law on
September 6, 2011, and
WHEREAS, AB 936 requires an agency or public body to adopt a
resolution that declares whether or not it has forgiven, during the period of time
between January 1, 2010 and December 31, 2011, the repayment, wholly or
partially, of any payment, debt, or financial indebtedness owed by the agency to
the public body or by an agency to the public body; and
WHEREAS, for the purposes of complying with AB 936 the City of Poway
is a public body and the former Poway Redevelopment Agency was an agency
during the time period specified by the law.
NOW, THEREFORE, the City of Poway does resolve as follows
Section 1 The City hereby finds and determines that the foregoing
recitals are true and correct
Section 2 The City of Poway does hereby certify that the City of Poway
did not forgive the repayment, wholly or partially, of any loan, advance, or
indebtedness that had been owed by the Poway Redevelopment Agency to the
City of Poway during the period of time between January 1, 2010 and December
31, 2011
Section 3 The City of Poway further certifies that the Poway
Redevelopment Agency did not forgive the repayment, wholly or partially, of any
loan, advance, or indebtedness that had been owed by the City of Poway to the
Poway Redevelopment Agency during the period of time between January 1,
2010 and December 31, 2011.
