A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
CALIFORNIA, AUTHORIZING THE ANNEXATION OF CITY OF
POWAY TRACT 86-05 IN TO POWAY LANDSCAPE
MAINTENANCE ASSESSMENT DISTRICT 83-01
WHEREAS, the City Council of the City of Poway, California,
approved City of Poway Tract Map 86-05 on December 15, 1985,
and
WHEREAS, pursuant to Ordinance No. 80 of the City of Poway,
Condition 14 of Section 2 of City of Poway Resolution P 86-85
requires that all landscaping associated with the dedicated
open planted area, and noise attenuation walls adjacent to
and within City of Poway Tract 86-05 be maintained through
owner participation in a landscape maintenance district; and
WHEREAS, it is the desire of the City Council of the City
of Poway, California to annex the above referenced areas into
Poway Landscape Maintenance Assessment District 83-01.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Poway does hereby resolve the following:
1. Pursuant to Article 2, Chapter 2, Part 2, Landscaping
and Lighting Act of 1972, Section 22605 through
22608.2 inclusive, dedicated open planted areas and
noise attenuation walls adjacent to and within City
of Poway Tract 86-05 is annexed into Poway Landscape
Maintenance District 83-01.
2. Proposed assessments shall be as detailed in the
"Engineers Report for Poway Landscape Maintenance
Assessment District 83-01 for 1987-88."
PASSED, ADOPTED, AND APPROVED by the City Council at a
regular meeting this 15th day of December, 1987.
