MINUTES OF THE CITY COUNCIL REGULAR MEETING
DECEMBER 1, 1992
The December 1, 1992, regular meeting of the City Council of the City of
Poway, was called to order at 7:05 p.m., by Deputy Mayor Pro Tem Emery at the
City Council Chambers, 13325 Civic Center Drive, Poway, California.

NOVEMBER 3, 1992
GENERAL MUNICIPAL ELECTION
A. City Clerk Wahlsten reported the results of the November 3, 1992 General
Municipal Election held to elect two members of the Council for four -year
terms and to vote on Proposition S, "Shall an ordinance of the City of
Poway be adopted which would require voter approval of land use changes
which would permit an asphalt plant in the South Poway Planned Community ?"
She stated that the total number of votes cast was 21,162 out of 26,775
registered voters. The candidates receiving the highest number of votes
were Bob Emery, 11,665, and Susan Callery, 8,745. Proposition "S" passed
with 14,174 affirmative votes. A Special Municipal Election to elect a
Mayor for a two -year term was also held and Don Higginson received the
highest number of votes, 13,619.

B. Motion by Councilmember Higginson, seconded by Councilmember Snesko, to
adopt Resolution No. 92 -199, entitled, "A Resolution of the City Council
of the City of Poway, California, Reciting the Fact of the General
Municipal and Special Municipal Elections held in said City on November 3,
1992, Declaring the Result Thereof and Such other Matters are Provided by
Law." Motion carried 3 -0 with Councilmember McIntyre absent and one
vacancy.
Proposition "S" will become effective on November 13, 1992 and was
assigned Ordinance No. 371, entitled, "An Ordinance of the City of Poway,
California Requiring Voter Approval of Land Use Changes Which Would Permit
an Asphalt Plant in the South Poway Planned Community."
City Clerk Wahlsten stated that, as a result of the election of
Councilmember Higginson as Mayor at the November 3, 1992 Special Election,
there is a two -year Council term that is vacant. The Council has thirty
days from the commencement of the vacancy to either fill by appointment
for the balance of the term or by calling for a special election. She
declared that a vacancy now exists on the Council.
D. City Clerk Wahlsten administered the oaths of office and presented
Certificates of Election to Mayor Don Higginson and Councilmembers Bob
Emery and Susan Callery,
E. Motion by Councilmember Snesko, seconded by Councilmember Callery to
appoint Councilmember Emery as Deputy Mayor. Motion carried 4 -0 with one
vacancy.

FILLING COUNCIL VACANCY
Mayor Higginson explained the options of appointment and
the process that was used on the two prior occasions when
the Council.

Emery to fill the vacancy by appointment; to accept applications from qualified
citizens until 5:00 p.m. on Friday, December 4, 1992; to schedule a workshop for
5:30 p.m. on Monday, December 7, 1992 to interview the applicants; and to place
this item on the December 8, 1992 agenda for a possible appointment. Motion
carried 4 -0 with one vacancy.

PROCLAMATION
Mayor Higginson presented a proclamation for December, 1992 as "National Drunk
and Drugged Driving (3D) Prevention Month" to Sheriff's Captain Collins.

Mayor Goldsmith explained the procedure for Public Oral Communications. There
was no one present wishing to speak.

14. Approval of Planning Resolution No. P- 92 -70, entitled, "A Resolution of
the City Council of the City of Poway, California Approving Comprehensive
Sign Program 92 -04, Assessor's Parcel Number 317- 490 -04, 06 and 07;" La
Jolla Mortgage, applicant; for the commercial building at 17250 Poway

CITY MANAGER ITEMS
City Manager Bowersox congratulated Mayor Higginson and Councilmembers Emery and
Gallery on their election.
MAYOR AND CITY COUNCIL-INITIATED ITEM
19. Councilmember Callery requested that "graffiti" markings on the sidewalks
and streets left by the utility companies be removed in a more timely
manner.
20A. Councilmember Emery requested staff report back on the feasibility of an
engineering study to determine the stability of "tooth rock," the
prominent feature east of Espola Road at the terminus of Twin Peaks Road.
Council concurred.
20B. Motion by Councilmember Emery to request staff prepare a specific plan for
the northwest corner of Oak Knoll and Poway Roads, seconded by
Councilmember Snesko and carried 4 -0 with one vacancy.
20C. Councilmember Emery stated that the number one issue in this past campaign
was how the City would address housing needs in the future. He suggested
that a sub - committee of the Council be formed in order to "go on the
offense" in this area. Motion by Mayor Higginson, seconded by
Councilmember Emery that they be a Council Housing sub - committee. Motion
carried 4 -0 with one vacancy.
21. Mayor Higginson announced that Jim Hall is his appointment to the Parks &
Recreation Committee.
Upon motion by Councilmember Emery, seconded by Councilmember Snesko, Mayor
Higginson ordered the meeting adjourned to 5:30 p.m., Monday, December 7, 1992,
to interview the candidates for the City Council vacancy in the City Council
Chambers, 13325 Civic Center Drive, Poway, California. The time of adjournment
was 7:26 p.m.
