A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE PLAN OF THE ADOPTED
SOUTH POWAY PLANNED COMMUNITY DEVELOPMENT
PLAN (GPA 87-03)
WHEREAS, the City council of the City of Poway recognizes that
the need may arise to amend the city's General Plan; and
WHEREAS, Section 65350, et seq., of the california Government
Code describes the procedures for amending General Plans; and
WHEREAS, the City council approved the South Poway Planned
Community Development Plan on July 30, 1985 and said Development
Plan is a component of the Poway General Plan and is intended to
serve as the specific plan for the South Poway area; and
WHEREAS, property owner, McMillin Financial Development, Inc.
filed an application, GPA/ZC 87-03 requesting a modificaton of
land use designation and zone classification on assessor parcels
320-011-01 (135.27 acres), 320-011-02 (7.92 acres), and a portion
of 320-011-03 (10.53 acres) having a total area of approximately
153.72 gross acres and located on the east and west sides of the
existing Pomerado Road and at the southwest corner of the future
intersection of the new Pomerado Road and the South Poway Parkway;
and
WHEREAS, the proposed amendment area is within the project
boundaries of the adopted South Poway Planned Community Development
Plan and said area is presently designated under the Development
Plan as Rural Residential A (1 du/4, 8, 20, or 40 net acres) and
Single Family 2 (1-2 du/net acre) and the single Family 2 area is
approved for 60 dwelling units pursuant to the said Development
Plan, and the RR-A area is estimated to yield three dwelling units,
for a total of 63 units for the applicant's property; and
WHEREAS, the application requests a change in land use and
zoning from Rural Residential A (1 du/4. 8 .20 or 40 net acres),
RR-A and Residential Single Family 2 (1-2 du/net acres), RS-2 to
Residential Single Family 2 consisting of 122 dwelling units and
South Poway Commercial SPC consisting of approximately 6.65 acres
of commercial land use; and
WHEREAS, the city of Poway held a properly noticed public
hearing in accordance with the california Government Code and the
California Environmental Quality Act to consider that request; and
WHEREAS, the city council considered the EIR addendum prepared
for the proposed amendment along with the Final EIR for the South
Poway Plan and determined that the addendum made the original EIR
adequate for the proposed amendment; and

WHEREAS, at the public hearing of December 22, 1987, the City
Council also considered a staff-prepared alternative to the pro-
posed amendment which consisted of a total of 105 dwelling units
for the site in question and the addition of 6.65 net acres of
South Poway commercial land use to be located at the southwest
corner of the future intersection of the new Pomerado Road and the
South Poway Parkway; and
WHEREAS, the City Council finds that the said alternative is
consistent with the policies and objectives of the Poway General
Plan regarding the South Poway area, is in substantial conformance
with the intent, policies, objectives and standards of the adopted
South Poway Planned Community Development Plan, would not result in
a significant increase in environmental effects for the South Poway
area as identified in the Final EIR for South Poway and in the EIR
addendum prepared for the subject site, and is in substantial
compliance with the findings made under Resolution No. 85-44 which
enacted the South Poway Planned Community Development Plan; and
WHEREAS, the City Council further finds that the above
mentioned final EIR and addendum adequately fulfill the CEQA
requirements for this alternative amendment and hereby issues a
Mitigated Negative Declaration.
NOW, THEREFORE, BE IT RESOLVED that the City council hereby
amends the land use plan of the adopted South Poway Planned
Community Development Plan pursuant to the staff-prepared alter-
native amendment as described above.
APPROVED and ADOPTED by the city council of the City of Poway,
State of california, this 22nd day of December, 1987.
