A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ORDERING THE SUMMARY VACATION
OF A WATER EASEMENT WITHIN:
SEE ATTACHED LEGAL DESCRIPTION TITLED "EXHIBIT A"
(VACATION 88- 03 )
WHEREAS, the City Council of the City of Poway desires to sum-
marily vacate a certain public service easement in accordance with
the procedures provided in Chapter 4, Part 3, Division 9 of the
Streets and Highways Code of the State of California, commencing
at Section 8330; and
WHEREAS, a water easement within the attached legal description
titled "Exhibit A" was dedicated to the City of Poway per a docu-
ment recorded as F/P 77-412369 in Book 1977 on October 7, 1977 in
the office of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Poway as follows:
This summary vacation is made under the provisions of
Chapter 4, Part 3, Division 9 of the Streets and Highways
Code of the State of California.
The City Council hereby finds that the herein described
water easement has been superseded by relocation and there
are no other public facilities within the easement.
The City Council hereby declares that the following
described water easement is hereby vacated:
See attached leaal description titled "Exhibit B."
The City Clerk of the City of Poway is hereby directed to
cause a certified copy of this resolution to be recorded in
the office of the Recorder of San Diego County in accor-
dance with the provisions of Section 8336 of the Streets
and Highways Code.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City
of Poway, California, at a regular meeting this 26th day of April,
1988.

Exhibit "A"
Legal Description
Ail that portion of the west half of the southeast
quarter of Section 35, Township 13 South, Ranch 2 West,
San Bernardino Base and Meridian, in the City of Poway,
County of San Diego, State of California, according to
the United States Government Survey, approved April 11,
1876, which lies southerly of the northerly line of the
southerly 1980.00 feet (measured along the east line
thereof) of said west half.
Excepting therefrom the southerly 990.00 feet (measured
at right angles) of the above described land.
Also all that portion of lots 3 and 4 in said Section
35, which lies between the westerly prolongation of the
northerly and southerly lines of the above described
land and easterly of the center line of the main public
highway route three (3).

E~sement to be Vacated
That portion of Parcel 3 of Document No. 77-412369 filed in the
Office of the County Recorder of San Diego County, State of Cali-
fornia, on October 7, 1977; the centerline of said 20' wide portion
of Parcel 3 being further described as follows:
Commencing at the Southeasterly terminus of that certain course
designated in said Parcel 3 of aforementioned document No.
77-412369 as "South 18o58'48'' East 105.24 feet,"
Thence South 22°00'21'' East 35.00 feet to the TRUE POINT OF
BEGINNING;
Thence continuing South 22°00'21'' East 65.55 feet;
Thence South 26°51'15'' East 150.03 feet;
Thence South 28000'00'' East 88.15 feet to the beginning of a
tangent 300.00 foot radius curve concave Westerly;
Thence Southerly along the arc of said curve, through a central
angle of 2000'00'' a distance of 10.47 feet to a point hereinafter
known as Point "C";
Thence continuing Southerly along the arc of said curve through
a central angle of 27045'55'' a distance of 145.38 feet;
Thence tangent to said curve South 1°45'55'' West a distance of
6.00 feet to a point in that certain course designated in Parcel 1
of said Document No. 77-412369 as "South 88°14'05'' East 713.00
feet" distant thereon North 88°14'05'' West 25.00 feet from the
Easterly terminus thereof.
And all of Parcel 4 as described in document recorded October 7,
