Res 88-032RESOLUTION NO. 88-032 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, STATE OF CALIFORNIA, DECLARING THE INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN THE POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 86-1 FOR FISCAL YEAR 1988-89 WHEREAS, the City Council of the City of Poway desires to levy and collect assessments within Poway Landscape Maintenance Assessment District 86-1 for the purpose of maintaining, servicing and operating public landscape facilities located within the terri- tory comprising of said district as shown in Exhibit "A", pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, the public interest and convenience requires the main- tenance, service and operation of the public landscaping, sound- walls, recreational trails, and future parks within said territory. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: 1. The foregoing recitals are true and correct and the City Council so finds and determines. Proposed assessments for 1988-89 are as detailed in the Engineer's Report for Poway Landscape Maintenance Assessment District No. 86-1 for fiscal year 1988-89, Attachment 2. Pursuant to the Streets and Highways Code, a public hearing will be held on June 7, 1988 in the City Council Chambers at City Hall to consider the levy and collection of the proposed assessments. The Assessment District was formed June 12, 1986 as a means of financing the maintenance of landscape improvements installed in conjunction with new sub- divisions in Poway, the boundary being as shown in Exhibit "A". FINDINGS The Landscape and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvements which include the facil- ities existing within the subject assessment district. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: "The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." Based upon the foregoing, it is proposed that the City of Poway generate the necessary revenue required to maintain the aforemen- tioned landscaping improvements with Landscape Maintenance Assessment District No. 86-1 for the 1988-89 fiscal year using the method provided for in the Landscape and Lighting Act of 1972. ENGINEERING ANALYSIS Boundary The boundary of the proposed assessment district is as shown on Exhibit "A" with City of Poway Tracts 4090R, 4091R, 4092R, 4093R, 4158, 84-08, 86-01 and 3545, being the present full extent of the district (619 units). Exceptions from the assessment of said costs and expenses within the area described are: all public streets, public avenues, public lanes, public roads, public drives, public courts, public alleys, all easements and right-of-way, all public parks, greenbelts and parkways, and all public school property being used for public school purposes. FACILITIES The facilities to be maintained are defined as the landscaping and soundwalls within the right-of-way and adjacent to Espola Road and Del Poniente Road; the recreational trails and sidewalks, green- belts and open space corridors within the district boundaries. EXISTING CONDITIONS OF LANDSCAPE MAINTENANCE WITH DEVELOPED SUBDIVISIONS OF DISTRICT Each of the respective subdivisions in the district has been inven- toried and evaluated to insure compliance with required improve- ments. Landscape maintenance and performance standards and specifications have been developed to assure a continuing level of quality to landscape care of assessment district properties. BENEFIT ANALYSIS The District encompasses eight tract developments along the Espola Road corridor. Tracts 4090R to 4093R have an aggregate total of 415 units while TM3545 has 78 units, TM4158 has 21 units, TM84-08 has 73 units, and TM86-01 has 32 units. The total number of units within the District is 619. The assessment will be calculated on a per unit basis by dividing the required revenue by 619. PROPOSED BUDGET 1. Contract $ 95,375 2.
