Res 88-034RESOLUTION NO. 88- 034 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DECLARING THE INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN THE POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 87-1 FOR FISCAL YEAR 1988-89 WHEREAS, the City Council of the City of Poway, California desires to levy and collect assessments within Poway Landscape Maintenance Assessment District No. 87-1 for the purposes of maintaining, servicing and operating public landscape facilities located within the territory comprising said district as shown in the Engineer's Report {Attachment "A"}, pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, the public interest and convenience requires the maintenance, service and operation of the public landscaping, soundwalls, and recreational trails within said territory. NOW THEREFORE, the City Council of the City of Poway does hereby resolve as follows: The foregoing recitals are true and correct and the City Council so finds and determines. e Proposed assessments for 1988-89 are as detailed in the "Engineer's Report" for Poway Landscape Maintenance Assessment District No. 87-1 for 1988-89 fiscal year, Attachment "A". Pursuant to the Streets and Highways Code, a public hearing will be held on June 7, 1988, in the City Council Chambers at City Hall to consider the levy and collection of the proposed assessments. Wablstedt, City Clerk ~ City of Poway Resolution No. 88-034 Page 3 ENGINEER'S REPORT FOR POWAY LANDSCAPE MAINTENANCE ASSESSMENT' DISTRICT NO. 87-1 FOR 1988-1989 FISCAL YEAR PURPOSE The purpose of this Report is to set forth findings and engineering analysis for the Poway Landscape Maintenance Assessment District No. 87-1 for 1988-1989 fiscal year. The Assessment District was formed January 27, 1987 as a means of financing the maintenance of landscape improvements installed in conjunction with the Pomerado Business Park, the boundary being as shown in Exhibit A. FINDINGS The Landscaping and Lighting Act of 1972 permits the establish- ment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvements which includes the facilities exiSting within the subject assessment district, the 1972 Act requires that maintenance assessments be livied according to benefit rather than according to estimated value. Section 22573 states: "The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." ENGINEERING ANALYSIS Facilities The facilities to be maintained are shown on the approved landscaping plans for the project and are briefly described as follows: Roadway medians in Pomerado Road, South Poway Parkwgy, and Community Road, soundwalls, retaining walls, and adjacent parkways along Pomerado Road; detention basins; equestrian trails and equestrian staging areas. The Landscaping plans are incorporated in the Report by reference. ATTACHMENT A Resolution No. 88-034 Page 4 Engineer's Report Page 2 Cost Estimate It is anticipated that landscaping will be accepted for maintenance in late fiscal year 1988-1989 or early fiscal year 1989-1990. Therefore, the assessments must be collected in fiscal year 1988- 1989. The estimates for a six-month maintenance period are $194,570 (Exhibit "C"). Assessment Diagram The boundary of the proposed Assessment District and the individual parcels are shown on Exhibit A. The following areas are excluded from assessments for the district: Ail public streets, public avenues, public lanes, public roads, public drives, public courts, public alleys, public righ-of-ways, all public parks, greenbelts and parkways, and all public school property used for public school purposes. Method of Assessment In order to provide an equitable assessment, 50% of the cost way distributed evenly over all the lots. The remaining 50% was then approtioned to the lots based on their net usable acreage. The calculations are shown in tabulated form on Exhibit B, along with the corresponding assessor parcels.
