AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING POWAY MUNICIPAL CODE
CHAPTERS 5.02 AND 17.28 PERTAINING TO
BUSINESS CERTIFICATES AND HOME OCCUPATION PERMITS
WHEREAS, Title 5 of the Poway Municipal Code is known as the Business
Licenses and Regulations Ordinance and contains standards enacted for the purpose of
protecting the public interest, health, welfare and safety by providing a means to ensure
that all new and existing businesses in the City are required to register and procure a
certificate from the City; and
WHEREAS, Section 5.02.110 proposes modification to the Business Certificate
renewal schedule; and
WHEREAS, Title 17 of the Poway Municipal Code is known as the Zoning
Ordinance and contains standards to ensure the public's health, safety, and welfare; and
WHEREAS, Section 17.28.010 proposes modification to the Home Occupations
General Requirements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
Section 1: Section 5.02.110 of the Poway Municipal Code is hereby amended as
follows:
5.02.110 Certificate — Term.
A. Certificates for New Businesses. Certificates for new businesses, whether new to the
City or resulting from a change of ownership, location or type of business, shall be issued
for a maximum term of 24 months.
B. Renewal of Existing Certificate. All certificates which are renewed shall be valid for a
24 month term unless otherwise revoked. Certificates shall be required to be renewed
before the expiration date shown on the Business Certificate.
The City shall notify all businesses at least 30 calendar days prior to the date of the
renewal.
Section 2: Section 17.28.010 of the Poway Municipal Code is hereby amended as
follows:
17.28.010 General requirements.
Home occupations may be permitted only when in compliance with the conditions listed
in this chapter. A permit must be issued by the Development Services Director prior to
operation of such use. The fee shall be in accordance with those adopted by City
Council resolution and the permit shall be issued for a term of 24 months.

Section 3: Section 17.28.010 (K) is hereby amended as follows:
K. Renewal of existing permit. All Home Occupation Permits which are renewed shall be
valid for a 24 month term unless otherwise revoked. Permits shall be required to be
renewed before the expiration date shown on the permit. The City shall notify all permit
holders at least 30 calendar days prior to the date of the renewal.
EFFECTIVE DATE. This Ordinance shall take effect thirty (30) days after the date of this
passage, and before the expiration of fifteen (15) days from the passage thereof shall be
published at least once with names and members voting for and against the same in the
Poway News Chieftain, a newspaper of general circulation, published and circulated in
the City of Poway and thenceforth and thereafter the same shall be in full force and
effect.
Introduced and first read at a regular meeting of the City Council of the City of
Poway this 3 day of April, 2012, and thereafter PASSED AND ADOPTED at a regular
meeting of said City Council held on the 17th day of April 2012.
