Ord 742 ORDINANCE NO. 742 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA PLACING AN AFFORDABLE HOUSING OVERLAY ZONE ON SIX SITES LOCATED THROUGHOUT THE CITY APNs 314 - 434 -66, 321 - 190 -28, 317 - 472 -01, 317 - 472 -06, 317 - 152 -14, and 275 - 460 -61 (ZC 12 -01) WHEREAS, on August 19, 2008, the City Council approved the City of Poway 2005 -2010 Housing Element; and WHEREAS, amendments to the Community Development Element of the General Plan were prepared that were necessary for consistency with the 2005 -2010 Housing Element update; and WHEREAS, the Residential Sites Inventory in the Housing Element identified 21 sites where very low, low, and moderate income housing developments could be placed; and WHEREAS this list of available sites is necessary to demonstrate to the State, through the Housing Element, the City's ability to achieve its Regional Housing Needs Assessment unit requirements; and WHEREAS, with the goal of preserving these sites for future affordable housing opportunities, the City has identified five undeveloped sites and one developed site owned by the Poway Housing Authority to receive the Affordable Housing (AH) Overlay designation; and WHEREAS, on April 3, 2012, the City Council held a duly advertised public hearing to solicit comments from the public relative to this application. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1: A Negative Declaration was approved on August 19, 2008, for the 2005- 2010 Housing Element Update (GPA 08 -01). As the placement of the Affordable Housing Overlay zones was a requirement of the Housing Element Update, the previously issued Negative Declaration adequately addresses any potential environmental impacts associated with this project. No additional environmental review is required per State CEQA guidelines. Section 2: The City of Poway Zoning Map is amended as follows: A. An Affordable Housing -Low Overlay Zone (AH -L) shall be placed over four parcels: (1) a 2.6 -acre parcel, APN: 317 - 472 -01, located at 13021 Poway Road, in the Mixed Use (MU) zone; (2) a 0.31 -acre parcel, APN 317 - 472 -06, located at 13031 Poway Road, in the Mixed Use (MU) zone; (3) a 2.06 -acre parcel, APN 275 -460- 61, located at 12674 Monte Vista Road, in the Commercial Office (CO) zone; and (4) a 3.18 -acre parcel (317- 152 -14) located on the southwest corner of Ordinance No. 742 Page 2 Pomerado Road and Oak Knoll Road in the Community Business (CB) zone, as shown in Exhibit A. B. An Affordable Housing - Moderate Overlay Zone (AH -M) shall be placed over two parcels: (1) a 6.77 -acre parcel, APN 314 - 434 -66, located at 14399 Community Road, in the Residential Single - Family 7 (RS -7) zone; and (2) a 2.15 - acre parcel, APN 321 - 190 -28, located on the south side of Twin Peaks Road, near the Espola Road intersection, adjacent to, and west of, the Circle K store, as shown in Exhibit A. EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30) days after its adoption. CERTIFICATION /PUBLICATION: The City Clerk shall certify the adoption of this Ordinance and cause it, or a summary of it, to be published with the names of the City Council members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation in the City of Poway within fifteen (15) days after its adoption and shall post a certified copy of this Ordinance in the Office of the City Clerk in accordance with Government Code §36933.
