A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, ORDERING THE SUMMARY VACATION OF AN EASEMENT AND
RIGHT-OF-WAY FOR INGRESS AND EGRESS FOR ROADWAY PURPOSES IN THE
NORTHEAST QUARTER OF SECTION 21, TOWNSHIP 14 SOUTH,
RANGE 2 WEST, SAN BERNARDINO MERIDIAN
(VACATION 88-06 )
WHEREAS, the City Council of the City of Poway desires to sum-
marily vacate a certain public service easement in accordance with
the procedures provided thereof in Chapter 4, Part 3, Division 9 of
the Streets and Highways Code of the State of California, com-
mencing at Section 8330; and
WHEREAS, that certain easement and right-of-way for ingress and
egress for road purposes in the Northeast Quarter of Section 21,
Township 14 South, Range 2 West, San Bernardino Meridian was dedi-
cated to the Pomerado County Water District on May 28, 1963 as
Document No. 53223, Series 4, Book 1963 of Official Records of the
San Diego County Recorder; and
WHEREAS, upon incorporation of the City of Poway on December 1,
1980, the City became the successor in interest to said easement;
and
WHEREAS, said easement and right-of-way is commonly used as an
access road to the City of Poway Sewage Treatment Plant located at
approximately 1,500 feet south of the intersection of Poway Road
and Sabre Springs Parkway.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Poway as follows:
This summary vacation is made under the provisions of
Chapter 4, Part 3, Division 9 of the Streets and Highways
Code of the State of California.

The City Council hereby finds that the hereinbelow
described easement and right-of-way for ingress and egress
for roadway purposes has been superceded by relocation and
there are no other public facilities located within the
easement (Section 8333c) and that there are no in place
public utility facilities that are in use and would be
affected by the vacation (Section 8334.5).
3. The City Council hereby declares the following public ser-
vice easement vacated:
That certain public service easement granted to the
Pomerado County Water District on March 28, 1963 as
Document No. 53223, Series 4, Book 1963 of Official
Records of the San Diego County Recorder, described as
follows:

An easement and right-of-way for ingress and egress for
road purposes across that portion of the Northeast
Quarter of Section 21, Township 14 South, Range 2 West,
San Bernardino Meridian, in the County of San Diego,
State of California, 25.00 feet wide, lying 12.50
feet of east side of the following described line:
Beginning at a point on the Southerly line of the
County Road known as Road Survey No. 987, according to
Map thereof on file in the Office of the County Sur-
veyor of said San Diego County, said point being
located opposite center line station 47 plus 00.85,
according to said Map; thence South 3°39'11'' West 15.65
feet to the beginning of a 100.00 foot radius curve
concave Easterly; thence Southerly and Southeasterly
along said curve 74.37 feet through a central angle of
42°36'30"; thence tangent to said curve, South 38o57'08''
East 109.47 feet to the beginning of a tangent 5000.00
foot radius curve concave Southwesterly; thence
Southeasterly along said curve 99.14 feet through a
central angle of 1°08'10"; thence tangent to said
curve, South 37048'58'' East 147.75 feet to the
beginning of a tangent 140.00 foot radius curve concave
Westerly; thence Southerly along the arc of said curve
207.53 feet through a central angle of 84°55'54";
thence tangent to said curve, South 47006'56'' West
380.84 feet to the beginning of a tangent 120.00 foot
radius curve concave Northwesterly; thence South-
westerly along the arc of said curve 108.89 feet
through a central angle of 51°59'33"; thence tangent to
said curve, North 80°53'31" West 561.86 feet to the
beginning of a tangent 75.00 foot radius curve concave
Southeasterly; thence Southwesterly along the arc of
said curve 115.18 feet, through a central angle of 87°
59'20"; thence tangent to said curve, South 11°07'09''
West 60.18 feet to the beginning of a tangent 220.00
foot radius curve concave Northwesterly; thence South-
westerly along the arc of said curve to its intersec-
tion with the Northerly line of that certain parcel of
land described in deed to the Pomerado County Water
District, recorded May 1, 1958 as Document No. 70095 in
Book 7062, Page 443 of Official Records.
The side lines of said easement to be shortened or
lengthened to terminate in the Southerly line of the
County Road Survey No. 987, and in the Northerly line
of the aforesaid parcel of land described in Book 7062,
Page 443 of Official Records.
The City Clerk of the City of Poway is hereby directed to
cause a certified copy of this resolution to be recorded in
Resolution No.

the Office of the Recorder of San Diego County in accor-
dance with the provisions of Section 8336 of the Streets
and Highways Code.
PASSED, ADOPTED AND APPROVED by the City Council of the City of
