A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE GENERAL PLAN
OF THE CITY OF POWAY COMPREHENSIVE PLAN
(GPA 88-02A)
WHEREAS, the City Council of the City of Poway recognizes that
the need may arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government
Code describes the procedures for amending General Plans; and
WHEREAS, on July 30, 1985, the City Council adopted a resolu-
tion approving the South Poway Planned Community (SPPC) Development
Plan, and said plan has been prepared and adopted as a specific
plan, and therefore, is a component of the Poway General Plan and
provides for the systematic implementation of such; and
WHEREAS, Volume 2 (Development Standards) of the SPPC
Development Plan contains procedures for amending the subject
Development Plan; and
WHEREAS, the City Council has initiated a General Plan
Amendment (GPA 88-02A) involving amendments to the text of the
adopted South Poway PC Development Plan (Volume 1, Development Plan
and Volume 2, Development Standards); and
WHEREAS, on July 26, 1988, the City Council of the City of
Poway held a properly noticed public hearing in accordance with the
California Government Code and the California Environmental Quality
Act (CEQA) to consider that request; and
WHEREAS, at said public hearing the City Council considered the
Final Subsequent Environmental Impact Report (SEIR) prepared for
the SPPC Development Plan, and said Final SEIR along with the pre-
viously certified Final EIR adequately address the proposed SPPC
Development Plan amendments; and following the public hearing, the
City Council adopted a resolution certifying the Final SEIR as
complete and adequate in accordance with CEQA; and
WHEREAS, the City Council finds that the Final SEIR along with
the previous Final EIR concluded that the proposed amendments will
not result in any significant environmental impacts, in that all
potential impacts will be mitigated to an insignificant level, and
therefore, said EIR's are adequate for the proposed SPPC
Development Plan amendments under GPA 88-02A.

NOW, THEREFORE BE IT RESOLVED that the city Council does hereby
amend the text of the South Poway PC Development Plan (Volumes 1
and 2) as follows:
Volume 2 (Development Standards), Chapter 3, Section III (B.3.)
- Site Utilization/Setbacks shall hereby be amended by adding
the following new NOTE NO. 7 to read as follows:
In cases where approved lots within the PC Development Plan
have two front yards each of which adjoin a street, building
setbacks may be reduced within one of the front yards so long
as the subject yard does not front a major PC circulation
arterial or collector roads including Community Road, Midland
Road, Stowe Drive, Kirkham Road, Pomerado Road, and South Poway
Parkway. In all cases, the required exterior side yard (corner
parcel) setback of 35 feet shall be maintained.
The following criteria shall be utilized in determining the
appropriateness of a reduced front yard setback. If substan-
tially met, such reduced setback may be approved by the City.
Front Yard Setback Reduction Criteria
Ail structures shall meet minimum intersection sightline
requirements.
The building footprint shall not conflict with necessary
utility lines.

Overall site landscaping and parking requirements shall be
met. If a reduced building setback impacts the required
parking area setback requirement (25 feet), no parking
shall be permitted within reduced building setback area.
Building line offsets shall be required to minimize the
potential linear appearance of industrial and commercial
structures.
Required loading areas and facilities shall not be
impacted, including adequate maneuvering areas for trucks
and other large vehicles.
The entire length of the building shall have an average
front yard setback of 35 feet and no part of the structure
shall be closer than 20 feet measured to the property
line.

Volume 2 (Development Standards), Chapter 3, Section III (B.2.)
- Site Utilization/Coverage shall hereby be modified by
deleting the crossed-out language and adding the dashed,
underscored language as indicated below:

shall hereby be amended as follows:

Industrial Park, and Light Industrial uses as follows:

The corresponding Subarea Land Use Acreage Analysis (Net
Acreage) tables within Volume 1 shall hereby be modified
appropriately to include the new column as identified above.
Volume 2 (Development Standards), Chapter V (Implementation
Procedures), Section I (Amendments/Adjustments) shall hereby be
modified by deleting the crossed-out language and adding the
underscored language as indicated below.
Processing and review of major amendments to the South Poway
Planned Community Development Plan will follow the same pro-
cedures as those for a General ~lan ~en~nt S_p~cific Plan
Amendment within the city of Poway !C~aRter 17.47~ Zoning
~e~e~opment Code).

Volume 2 (Development Standards), Chapter 3, Section I(E) and
Section II shall hereby be amended as follows:
Section I(E), List of Permitted, Conditional, and Prohibited
Use in the IP and LI Zones shall be amended by adding private
schools/pre-schools (child care) as a conditional use under
subsection (9), Other Uses (IP and LI Zones).
Section I(E) shall also be amended by adding retail-
warehousing uses as a conditional use under subsection (3),
Warehouses and Distribution (IP and LI Zones).
Section II, Use Standards for South Poway Commercial (SPC) Zone
shall hereby be amended by adding private schools/pre-schools
(child care) as a conditional use under subsection (C), Public
and Semi-Public Uses.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 26th day of July, 1988.
