Res 88-076RESOLUTION NO. 88-076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA AMENDING THE TEXT OF SEVERAL OF THE ELEMENTS OF THE GENERAL PLAN OF THE CITY OF POWAY COMPREHENSIVE PLAN (GPA 88-02B) WHEREAS, the City Council of the City of Poway recognizes that the need may arise to amend the City's General Plan; and WHEREAS, Section 65350, et, seq., of the California Government Code describes the procedures for amending General Plans; and WHEREAS, the subject City-initiated amendment adds new language to the text of the land Use Element, thereby establishing the "Open Space -Recreation" land use designation, and also amends appropriate corresponding sections of the Parks and Recreation Element, Water Resource Conservation Element, and Open Space Element; and WHEREAS, the city Council of the city of Poway held a properly noticed public hearing in accordance with the California Government Code and the california Environmental Quality Act to consider sub- ject General Plan amendment; and WHEREAS, the City Council finds that the subject General Plan Amendment 88-02B will not have a significant adverse impact on the environment and hereby adopts a Negative Declaration; and WHEREAS, the City Council further finds that the subject General plan text amendments are necessary and desirable to promote open space recreation land uses for the enjoyment and benefit of the community. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby amend the text of several of the Elements of the City of Poway General Plan by the addition of new language which shall read as follows: In order to maintain uniformity and internal consistency, the following land use designations within the Land Use Plan section of the Land Use Element shall be renumbered as indicated below. Planning Community Areas 18 - renumber to 17 Open Space 17 - renumber to 18 Open Space-Recreation Areas - assign new number 19 Resolution No. 88-076 Page 2 ® e The Land Use Plan section of the Land Use Element is hereby amended as indicated by the following underscored type: OPEN SPACE Open Space 18 - Open Space The Open Space category illustrates publicly- and privately-owned lands that are either in use or maintained in the natural, undeveloped state for future development or long-term preservation. The types of uses include City buildings, parks, schools, wilderness areas, and public facility operation centers. In the event one of the uses changes and the land is purchased by private individuals, a General Plan amendment shall be submitted to determine the appropriate future use. The following objective and policies are hereby added to the Land Use Element of the General Plan and shall read as follows: Objective 21. Open Space - Recreation Land Use The City should support and promote open space recreation oriented land uses in order to enhance active recreational opportunities within the community. These active-recreational opportunities will serve the recreational and social interaction needs of city resi- dents of all ages, economic situations, and physical conditions. Policy 21.a. Policy 21.b. Open Space-Recreation land uses pro- posed in the community shall meet the test of land use compatibility and shall be consistent with the appli- cable policies of the General Plan and the provisions of the Poway Municipal Code. In order to preserve open space in the community, no property with an existing land use and zoning designa- tion of open space-recreation (OS-R) shall be rezoned to any other zone until the provisions of the Poway Municipal Code are complied with. The following language is hereby added to the text of the General Plan under "Land Use Plan," following "Open Space 18. Resolution No. 88-076 Page 3 0 OPEN SPACE-RECREATION AREAS Open Space-Recreation Areas 19 - Open Space-Recreation The Open Space-Recreation land use category illustrates primarily privately-owned lands that provide a range of active-recreational opportunities within the community. These active-recreational opportunities will serve the recreational and social interaction needs of City resi- dents of all ages, economic situations, and physical con- ditions. A limited number of publicly-owned lands may also be included in this category. Examples of land uses allowed in the open space-recreation category include, but are not limited to, private swim, tennis, and racquet clubs, public and private golf courses, family fun cen- ters, soccer parks, riding academies and stables, mini- golf centers, and other active-recreation uses such as arcades and water-oriented activities. A General Plan amendment is prerequisite to the redesignation of land to the open space-recreation category in order to determine the appropriate future use of the land. Concurrent with the text amendments noted above, the land use legend of the Land Use and Circulation Plan map of the General Plan shall be appropriately modified. In order to provide uniformity and internal consistency within the General Plan text, several other elements are hereby amended to include additional General Plan policy statements as follows: Objective 6. PARKS AND RECREATION ELEMENT Private Recreational Facilities (new) Policy 6.g. The city should support and promote open space-recreation oriented land uses in order to enhance active recreational opportunities within the community. These active-recreational opportunities will serve the recreational and social interaction needs of City residents of all ages, economic situations, and physical conditions. Resolution No. 88-076 Page 4 WATER RES0URCE CONSERVATION ELEMENT Objective 1. Surface Waters (new) Policy 1.f. The city may determine desirable the establishment of open space-recreation land uses within the 100-year floodplain boundaries of the city's natural creek systems. OPEN SPACE ELEMENT Objective 1. (new) Policy 1.e. Open Space Preservation The City should support and promote open space-recreation oriented land uses in order to enhance active recreational opportunities within the community. These active-recreational opportunities will serve the recreational and social interaction needs of city residents of all ages, economic situations, and physical con- ditions. Objective 3. Creekside Areas (new) Policy 3.d. The city may determine desirable the establishment of open space- recreation land uses within the creekside areas. Objective 5. Public and Private Recreation Land (new) Policy 5.d. The city should support and promote open space-recreation oriented land uses in order to enhance active recreational opportunities within the community. These active-recreational opportunities will serve the recreational and social interaction needs of city residents of all ages, economic situations, and physical con- ditions.
