A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA ORDERING THE EXPUNGEMENT OF RECORD OF THAT
DECLARATION OF COVENANTS FOR STREET IMPROVEMENTS
APPERTAINING EDINA WAY AND TANNIN DRIVE WITHIN PARCEL
MAP NO. 10823
WHEREAS, a Declaration of Covenants for Street Improvements was
recorded on October 6, 1980 as F/P No. 80-328392; and
WHEREAS, said Declaration of Covenants was a condition imposed
by the County of San Diego in the filing of Tentative Parcel Map No.
16510; and
WHEREAS, said Tentative Parcel Map No. 16510 was recorded as
Parcel Map No. 10823 in the Office of the San Diego County
Recorder on December 18, 1980; and
WHEREAS, due to the pending summary vacation of those portions
of Edina Way and Tannin Drive within Parcel Map No. 10823, said
declaration of covenants will no longer be necessary; and
WHEREAS, the expungement of record of said Declaration of Cove-
nants for Street Improvements does not completely take away the
City's ability to impose necessary improvement requirements upon
application to the City for the development of any parcel within
said Parcel Map No. 10823.
NOW, THEREFORE, the City Council of the City of Poway, State of
California resolves as follows:
Orders the expungement of record of that Declaration of
Covenant for Street Improvements.
Directs the City Clerk to cause a certified copy of this
resolution to be recorded in the Office of the San Diego
County Recorder concurrent with or after the recordation
of that resolution ordering the summary vacation of Irre-
vocable Offer of Dedication for Public Highway for por-
tions of Edina Way and Tannin Drive and Clear Space
Easement within Parcel Map No. 10823.
PASSED AND APPROVED by the City Council of the City of Poway,
State of California, this 5th day of January, 1988.
