A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF POWAY, CALIFORNIA ORDERING THE SUMI~ARY
VACATION OF A PEDESTRIAN EASEMENT OVER LOT 3 OF
CITY OF POWAY TRACT MAP 84-04R, MAP NO. 11603 OF
THE OFFICIAL RECORDS OF SAN DIEGO COUNTY
WHEREAS, a pedestrian easement located within Lot 3 of City of
Poway Tract Map 84-04R was dedicated to the City of Poway and duly
accepted by the City of Poway upon recordation of said Tract Map on
September 4, 1986 as Map No. 11603, Document No. 86-388116 of the
Official Records of San Diego, County, and,
WHEREAS, the City Council of the City of Poway, California,
desires to summarily vacate a portion of this pedestrian easement
pursuant to the provisions of Chapter 4, Part 3, Division 9, Sec-
tion 8330 et sequitor of the Streets and Highway Code of the State
of California.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Poway as follows:
This summary vacation is made under the provisions of
Chapter 4, Part 3, Division 9 of the Streets and Highways
Code of the State of California.
The City Council hereby finds that the pedestrian easement
described below was acquired less than five years and more
than one year immediately preceding this vacation. Said
easement has not been in continuous use since the date of
dedication (Sec. 8333b). There are no in-place public
utility facilities that are affected by this vacation
(Sec. 8334.5). A vacation plat is on file in the office
of the City Clerk.
3. The City Council hereby declares that the following
described pedestrian easement is hereby vacated:
That portion of Lot 3 of City of Poway Tract 84-04R,
according to the Map thereof number 11603, recorded in the
Office of the County Recorder of San Diego County, State of
California, on September 4, 1986, described as follows:
Beginning at the most southwesterly corner of said Lot 3,
said corner being common to Lot 2 of said Map number 11603
and on the right-of-way of Country Creek Road, said corner
being radial to the center of a 50.00 foot radius cul-de-
sac, the center of which bears South 28 14'44" East, thence
along the line common to said Lot 3 and said Lot 2 North 23
02'33" West, 151.24 feet, thence leaving said common line
South 88 30'10" East, 10.99 feet, thence South 23 02'33"
East, 146.77 feet to the right-of-way of Country Creek

Road, thence along the arc of a circular curve having a
radius of 50.00 feet, concave southeasterly, the center of
which bears South 16 46'00" East, through a central angle
of 11 28'44" and an arc length of 10.02 feet to the point
of beginning.

The City Clerk of the City of Poway shall cause a certified
copy of this resolution to be recorded in the Office of the
Recorder of San Diego County in accordance with the provi-
sions of Section 8336 of the Streets and Highways Code.
PASSED, ADOPTED, AND APPROVED by the City Council of the City
of Poway, California at a regular meeting thereof this 2nd day of
February, 1988.
