A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
ORDERING THE SUMMARY VACATION OF PUBLIC SERVICE EASEMENTS
WITHIN THE NORTHWEST QUARTER OF THE SOUTHEAST QUARTER OF SECTION
2, AND THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION
2, TOWNSHIP 14 SOUTH, RANGE 2 WEST, SAN BERNARDINO MERIDIAN
IN THE CITY OF POWAY, STATE OF CALIFORNIA, ALL WITHIN
CITY OF POWAY TRACT NO. 4191-7R AND LOT 210
OF MAP NO. 8885
(VACATION VAC 88-02)
WHEREAS, the City Council of the City of Poway desires to sum-
marily vacate public service easements in accordance with the pro-
cedures provided thereof in Chapter 4, Part 3, Division 9 of the
Streets and Highways Code of the State of California, commencing at
Section 8330, and
WHEREAS, by separate instrument, a water line easement in por-
tions of Section 2, 11, and 12, T14S, R2W, SBM was granted to the
Poway Municipal Water District per Document No. 80-392581, recorded
November 21, 1980, and by separate instrument, a water line ease-
ment in portion of Section 1, T14S, R2W, SBM was granted to the
Poway Municipal Water District per Document No. 78-040488, recorded
January 31, 1978.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City
of Poway as follows:
This summary vacation is made under the provisions of
Chapter 4, Part 3, Division 9 of the Streets and Highways
Code of the State of California.
2. The City Council hereby finds that:
The hereinbelow described public service easements for
water line purposes has been superseded by relocation
and there are no other public facilities located within
the easements (Section 8333(c)).

The alternate locations of water line easements are
within the street right-of-way or a public service
easement in City of Poway Tract No. 4191-7R, said
street right-of-way and public service easement is
offered for dedication in said Tract 4191-7R.
The City Council hereby declares that the following public
service easements are hereby vacated conditioned upon the
City Council approval and recordation of City of Poway
Tract No. 4191-7R and acceptance of street right-of-way and

Those portions of Lots 209, 210, 248, and 275
designated as "portion of Lots 209, 210, 248, and 275
reserved for future street" on the map of County of San
Diego Tract No. 3461-7, recorded June 7, 1978, as Map
No. 8885, in the office of the County Recorder of San
Diego County, California.
The City Clerk is hereby authorized and directed to certify
to the passage ~f this resolution and to cause its recor-
dation in the Office of the Recorder of San Diego County.
PASSED, ADOPTED, AND APPROVED by the City Council of the City
of Poway, California, at a regular meeting thereof this 5 th day of
April, 1988.
