A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DENYING WITHOUT PREJUDICE
GENERAL PLAN AMENDMENT 88-03F
WHEREAS, the City Council of the City of Poway recognizes that the need ma~v
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code descri-
bes the procedures for amending General Plans; and
WHEREAS, the applicant, the City of Poway, has initiated a General Plan
Amendment, GPA 88-03F, for modifications of land use on assessor parcel
327-102-07 consisting of approximately 9.34 gross acres owned by Harry L.
Summers, Inc. and located on west of Community Road between Sycamore Tree Lane
and Hilleary Place; and
WHEREAS, the application proposes a change in land use from Rural
Residential-C (1 du/1, 2, or 4 net acres) to Open Space; and
WHEREAS, the City of Poway held a properly noticed public hearing in accor-
dance with the California Government Code and the California Environmental
Quality Act to consider that request; and
WHEREAS, at the public hearing, the property owner's legal counsel
testified that it is now the intent of the property owner to donate said pro-
perty to the City of Poway, and that said donation would be processed pursuant
to State and Federal tax laws; and
WHEREAS, the City Council determined, in light of the property owner's
intentions, that the proposed General Plan amendment is not appropriate.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby deny
without prejudice General Plan Amendment 88-03F.

California, this 27th da.v of September, 1988.
