A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ACCEPTING THE DEDICATION FOR STREET
PURPOSES OF CERTAIN ONE-FOOT WIDE STRIP OF LAND IN PORTIONS OF
LOTS 109 and 110, COUNTY OF SAN DIEGO TRACT 3503-2
MAP NO. 9256: HEATH DRIVE
WHEREAS, ON THE FINAL MAP OF Couty of San Diego Tract 3503-2
recorded June 20, 1979 as Map No. 9256, therein was offered for
dedication for public street purposes certain one-foot wide strip
of land at the northerly end of Heath Drive, being portions of Lots
109 and 220 of said map, and
WHEREAS, on said Map No. 9256, the Board of Supervisors of the
County of San Diego rejected said offer of dedication of said one-
foot wide strip as hereinafter more particularly described, and
WHEREAS, the State of California Government Code (Subdivision
Map Act) Section 66477.2(a) provides that a rejected offer of dedi-
cation shall remain open and may be accepted by resolution at any
later date, and
WHEREAS, upon incorporation on December 1, 1980, the City of
Poway became the successor in interest to the County of San Diego
for said offer of dedication, and
WHEREAS, in 1983 the residents north of and outside the limits
of said County of San Diego Tract 3503-2 improved the private road
portion of said Heath Drive, and
WHEREAS, since 1983 said residents have since used for ingress
and egress the dedicated public street portion of said Heath Drive,
and
WHEREAS, to accord their ingress and egress access rights
through said one-foot wide strip, it is in the best public
interest of the City of Poway said one-foot wide strip be now
accepted for public street purposes.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY, does
resolve, determine, and order as follows:
The City of Poway hereby rescinds the rejection of said
one-foot wide strip, and does hereby accept for public use
for street purposes those portions of Lots 109 and 110
designated "Portion of Lot 109 Reserved for Future Street"
and "Portion of Lot 110 Reserved for Future Street" on the
final map of County of San Diego Tract 3503-2, recorded on
June 20, 1979, as Map No. 9256, in the Office of the County
Recorder of San Diego County, California.
The City Clerk is hereby authorized and directed to certify
to the passage of this resolution and to cause its recorda-
tion in the Office of the Recorder of San Diego County.
