A RESOLUTION OF THE CITY COUNCIL
OF THE CITY-OF POWAY, CALIFORNIA,
ACCEPTING CERTAIN REAL PROPERTY
WITHIN THE CITY OF POWAY
FROM H. L. SUMMERS, INC.
WHEREA~, H. L. Summers, Inc., a California corporation holds fee title
to that certain real property located in the City of Poway, County of San
Diego, State of California ("Property") more particularly described on
Exhibit "A" attached hereto and incorporated by reference; and
WHEREAS, H. L. Summers, Inc., desires to convey the Property as a
charitable contribution to the City of Poway; and
WHEREAS, this gift of Property is not made to satisfy any obligation to
the City of Poway or as a requirement for development; and
WHEREAS, The City of Poway does not claim any right to the Property;
and
WHEREAS, the City Council may accept a gift of real property for its
City pursuant to Government Code Section 37354.
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts, on
behalf of the City of Poway, a gift of real property described in Exhibit
PASSED, ADOPTED AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting thereof this 25th day of October, 1988.

Township 14 South, Range 2 West, San Bernardino Meridian in the
City of Poway, County of San Diego, State of California according
to Official Plat thereof.
Excepting therefrom that portion lying Westerly of the
Easterly ~ines of City of Poway Tract No. 3926-4 according to Map
thereof No. 10347 and City of Poway Tract No. 3926-8 according to
Map thereof No. 10351 all recorded on February 26, 1982 in the
Office of the County Recorder of said San Diego County.
Also excepting therefrom that portion thereof lying within
Community Road as granted to the County of San Diego by deed
recorded May 6, 1966 as File/Page 76706 Official Records.
Also excepting therefrom those portions thereof lying within
the irrevocable offers of dedication for public highway as granted
to the City of Poway per document recorded August 12, 1981 as
File/Page 81-256847 and document recorded October 26, 1981 as
File/Page 81-337989 of Official Records.
