A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
INDEMNIFYING THE BOARD OF DIRECTORS OF
THE POINSETTIA MOBILEHOME PARK RESIDENTS ASSOCIATION
WHEREAS, the Poway Redevelopment Agency purchased the
Poinsettia Mobilehome Park on July 1, 1988; and
WHEREAS, the Poway Redevelopment Agency and City Council
operate the Poinsettia Mobilehome Park; and
WHEREAS, the Poinsettia Mobilehome Park Residents Association
was incorporated as a California Nonprofit Mutual Benefit Cor-
poration; and
WHEREAS, the Board of Directors of the Poinsettia Mobilehome
Park Resident's Association and its officers serve as advisors
the City concerning rules and policies for the Park; and
WHEREAS, the authority and responsibility to adopt such rules
and policies rests with the City; and
WHEREAS, the responsibility for the implementation and eniorce-
ment of such rules and policies rests with a manager employed
by the City.
NOW, THEREFORE, BE IT RESOLVED that the City of Poway does
agree to indemnify the Board of Directors of the Poinsettia Mobile-
home Park Residents Association and its officers and hold them
harmless from any and ali third-party ciaims, including claims lrom
members of the Residents Association, and any liability arising
from the City's/Agency's ownership of the park and the City's
leasing and operation thereof.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 15th day of November, 1988.
