Res 88-133RESOLUTION NO. 88-133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, ADOPTING THE SCHEDULE OF FEES AND FACILITIES USE REGULATIONS FOR THE CITY OF POWAY RECREATIONAL FACILITIES AND RESCINDING RESOLUTIONS 84-50 AND 86-099 WHEREAS, fees for use of City of Poway recreational established to provide for the recovery of operational associated with said facilities; and facilities have been and maintenance costs WHEREAS, rules and regulations have been established for the use of Poway recreational facilities; and NOW, THEREFORE, the City Council of the City of Poway does hereby resolve as follows: The Facility Use Regulations, Rules and Regulations for Operation of City of Poway Recreational Facilities, Classification of Applicants and Fees and Fee Schedule for Use of City of Poway Facilities as set forth in Attachments 1, 2, 3, and 4 are hereby adopted; and Resolutions 84-50 and 86-099 are hereby rescinded in order to effect said changes. Applications will be accepted Monday through Friday, 8:00 a.m. to 5:00 p.m., except holidays. Applications will be reviewed, use will be prioritized and fees, if any, set by the Recreation Supervisor and/or designated staff. Please refer to Application Procedures, Rules, and Classification of Applicants and Fee Schedule. APPLICATIOH PROCEDURES ANO POLICIES e Applications will be accepted for specific dates and times. Time requested must include all setup and cleanup time. Applications must be submitted at least ten {10) working days in advance of the date requested. With the exception of ballfield and court reservations, advanced sche- duling may be accepted one (1) year in advance for Poway residents. Nonresidents or nonresident groups advanced scheduling will be permitted only thirty {30) days in advance of the event. Regular hours of operation at Poway Community Park for use of the audi- torium are Monday through Sunday, 8:00 a.m. to 10:00 p.m. On Friday and Saturday nights, programs must end by 12:00 midnight, with a departure time no later than 1:00 a.m. Reservations at Lake Poway will end at sun- set. An additional fee will be charged for use of the facilities other than during regular hours of operation for all classifications. Applications will be approved for specific rooms, park areas, and ballfields, depending on group size, type of activity and availability. No activity shall be scheduled for more than room capacity. The Community Services Department may refuse or cancel any application. A written notices of refusal or cancellation with an appropriate explanation will be given by the Department. Applications for use may be denied for the following reasons: a. unsatisfactory prior use; b. harzardous condition exists; c. application submitted less than ten (10) days in advance; d. nonpayment of fees before due date; and e. higher priority activity takes precedence. If an application is denied, the decision may be appealed to the Community Services Manager. The next option, if the applicant is not satisfied, is to appeal the decision to the Director of Community Services. In the event of a change of plan, by applicant, notice of cancellation must be given to the Community Services Department twenty-one {21) days before to the date of intended use in order to avoid financial obligation for charges involved. A $1.50 processing fee will be charged and a refund, if applicable, will be mailed to the applicant. Checks or money orders are to be made payable to: City Of P~W~y, A $100 cleaning/damage deposit must be paid upon application approval. A percentage of the cleaning deposit may be refunded to groups upon verifi- cation of area cleanliness. The remainder of the fee is due twenty-one {21) days before the scheduled use. Groups using facilities on a weekly, semi-monthly, or monthly basis must pay on or before the first meeting of the month. Other arrangements may be approved by the Recreation Supervisor. A signed copy of the application by the Recreation Supervisor is confir- mation of the requested date. Any preparation for an event is soley at the applicant's risk. The Recreation Supervisor may impose additional requirements on the appli- cant as a condition of approval. These additional requirements may include, but not be limited to: {1) additional security, City staff or insurance; {2) if an application for facility use has been submitted less than ten {10} working days in advance, applications may be reviewed and accommodated subject to facility availability; {3} any financial obli- gations incurred by the City to accon~nodate the applicant will be deducted from the required deposit upon notice of cancellation; and {4) costs incurred for additional requirements shall be the responsibility of the applicant. (~)VERNXI~ FACiLiTY USE An employee of the Community Services Department shall be present during all hours of use. 2. Cleanup and refunds: On the day of the event, the applicant must initially inspect the pre- mises with a staff person and fill out a CO~ItlOn Of FaCility Report, This report is a checklist to ensure there is no negligence by either party {staff or applicant}. bo Groups are responsible for the following cleanup at the end of their event: 1. cleaning of all equipment used; 2. cleaning of any counter areas used; 3. cleaning and wiping all table tops used; 4. cleanup of any floor or carpet areas soiled or dampened; 5. cleanup of the kitchen and all amenities used {i.e., refrigerator, stove, oven and sinks); 6. disposing of all trash in proper receptacles; and 7. removal of all equipment supplies, personal articles, and displays in~nediately following cleanup. At the end of the rental and cleanup period, the applicant will inspect the premises with a staff person and complete the Condition of Faclllt~ Report, Attachment I Resolution No. 88-]33 Page 4 0 e 10. de If an applicant fails to perform cleanup after their activity, a per- centage of the deposit will be forfeited. If the facility is left in a satisfactory condition, a refund will be issued approximately three to four weeks after the date of the facility use. All groups must be under the direction of their own leadership. There must be at least one adult present and responsible for every twenty minors, and an adult must be present at all times. The City of Poway is not liable for accidents, injuries or loss of indivi- dual property in connection with any of its facilities. Groups which fall into moderate to high risk activity will be required to obtain liability insurance {rider clause to original policy), approved by the Recreation Supervisor, naming the City of Poway, its officers, and employees as additional insured. The City shall require liability insurance of $1 million to $5 million, depending upon the risk factor. No activity will be permitted which is in violation of local, state or federal statues. Applicants must adhere to all City policies and fire codes during their use of the facility. Groups are responsible for controlling noise that could be disturbing to other activities or the surrounding neighborhood. The Community Services Department reserves the right to full access for all activities in order to ensure that all rules and regulations are being observed, and may terminate the activity for the safety and welfare of the citizens or City property. Rental for use of parks is charged only for organized activities requesting specific areas. Liability insurance or security guards may be necessary depending on: (1) risk factor level, {2) alcohol, and {3) nature of use. No amplified music is permitted in outdoor areas in City parks without permit approval executed by the Director of Community Services. Groups having live musical entertainment or serving alcoholic beverages must abide by the following additional security requirements: a. Groups selling alcohol must obtain a "Daily On-Sale General License" from the Alcohol Beverage Control Board. be Guard service will be arranged by the applicant and approved by the Community Services Department. Guards will act as security forces and not as I.D. checkers. Additional guards may be required by the Recreation Supervisor, if needed. If minors are found to be in possession of alcoholic beverages, or if par- ticipants are found to be in possession of drugs, the activity will be terminated immediately. Attachment ! Community Services Department equipment is available for use in the City's facilities, but may not be removed to any other location without proper written authorization by the Recreation Supervisor. 13. When a conflict occurs, facility use permits held by nonsponsored groups may be cancelled by the Director of Community Services or his designated representative. As a rule, a minimum of two weeks notice will be given groups when a use permit is to be cancelled. 1.3 The City of Poway is not liable for accidents, injury or loss of indi- vidual property in its buildings or facilities. 1.4 Permission to use the building is granted by permit only and users are subject to observance of all City regulations. Permits may be revoked for violation of any City regulation. SECTION Z OEFINITION~ 2.1 CITY COUNCIL is the City Council of the City of Poway. 2.2 CITY is the City of Poway. 2.3 RECREATION FACILITIES are designated as City parks by the City Council including all land, water, road, improvements and facilities therein. 2.4 EMPLOYEE is a member of the City staff designated by the city Council or the City Manager to supervise the public use of the recreation faci- lities in compliance with the adopted rules and regulations. 2.5 CITY MANAGER is the City Manager of the City of Poway. 2.6 DIRECTOR OF COMMUNITY SERVICES is the Director of Community Services for the City of Poway. 2.7 CAMPING AREA is any area within the recreation facilities specifically designated for this purpose. 2.8 RULES AND REGULATIONS are duly adopted by the City Council. 2.9 LEISURE PROGRAMS. Programs organized, sponsored and/or conducted by the Community Services Department. 2.10 PUBLIC AGENCIES. Agencies serving the City of Poway such as School Districts, State of California, San Diego County, etc. Attachment 2 Resolution No, 88-133 Page 10 SECTIOH 3 AUTHOItlTY 3.1 AUTHORITY. These rules and regulations are adopted pursuant to State Law. The City Council may, from time to time by resolution, adopt additional rules supplementary to and consistent with these regulations and when so adopted, they shall have the same force and effect. 3.2 VIOLATIONS. Violations of City rules and regulations related to recreational facilities are enumerated in Section 9.48.010 through 9.48.290 of the Poway Municipal Code. Section 1.080.010 of the Code specifies the penalty for violations. 3.3 APPLICATION AND OTHER LAWS. In addition to City regulations, all other applicable Federal, State or County laws, ordinances, regulations and rules, including those relating to public health, sanitation and safety, are binding upon all persons within the recreation facilities. 3.4 ENFORCEMENT. All persons found or observed violating any of these regulations by an employee of the city will be ordered to leave the recreation facility. No one shall obstruct or interfere in any manner with an employee of the City in the exercise of his or her duties. 3.5 LIMIT OF CITY LIABILITY. All persons entering upon, remaining within, or using the recreation facilities shall do so entirely at their own risk. Neither the City, its Council, officers or employees shall be liable for any personal injuries or property damages or losses incurred by anyone entering upon, remaining within or suing the recreation facilities. 3.6 LIMITATIONS ON USE. The use of facilities must be compatible with the established purpose of that recreational facility. Use shall not include business or commercial activities, except by special agreement with the City of Poway Community Services Department and must be within the allotted permit time. Permit time schedules and charges must include all preparation and setup time, as well as cleanup time. The setting up of tables, chairs, etc., and storage of same at the conclu- sion of the activity is the responsibility of the permittee. Control of lights, keys, locks and locking of doors, gates, etc., will be the responsibility of the Community Services employee on duty. The duty employee or his assistant is authorized to refuse the use of the recreation facility, or any portion thereof, to any person whose use, in the sole Judgment of the employee, would constitute a hazard to the health and safety of that person or others. SECTIOH 4 HOURS OF OPERATIO# 4.1 CITY PARKS. City recreation areas shall be open from sunrise to sunset or as posted. LAKE POWAY. Fishing shall be conducted on days of the week as established from time to time by the City Council. CAMPING HOURS. The overnight camping area shall be available for Friday and Saturday nights of each month from 6:00 a.m. on Friday to 4:00 p.m. on Sunday, unless prior approval, in writing, is obtained from the Director of Community Services. No person without a valid camping permit shall camp overnight. No person shall enter upon, remain within, or use the camping area for any purpose whatsoever other than at times set forth in this section or in the permit. No person under 18 years of age may camp overnight unless accompanied by an adult. Said adult, if not the parent, must possess written parental or guardian permission and hold harmless agreement for that minor. This requirement may be waived if an eligible youth group has, or will obtain its own consents and will itself undertake the required inden- mity and hold harmless agreement. The hold harmless agreement must be filed with the City at least twenty-four {24) hours before the beginning of the camping period. Each youth group using the facility must be accompanied by a responsible adult{s} who guarantees observance of the established rules. SPECIAL PERMITS. The Director of Community Services, by special writ- ten permit, may provide under exceptional circumstances, for eligible youth groups and the public to camp at other times and in greater numbers than otherwise provided in this section. CLOSURE. The recreation facilities, or portions thereof, shall be open or closed when deemed necessary within the discretion of the Director of Community Services. The City Council, City Manager or any employee the City designated by them are hereby authorized to close the recreation facilities for and during such times as are necessary for its management, maintenance, repair, protection or conservation and for the safety of the public. Being under the influence of any Intoxicating beverages or dangerous drugs and other substances prohibited by the California Health and Safety Code is prohibited. ALCOHOLIC BEVERAGES. Alcoholic beverages may be used in designated facilities by special permit from the City. When alcoholic beverages are permitted, a security person or persons must be present as approved by the Director of Community Services. WEAPONS AND FIREWORKS. The use, transportation, carrying firing, or discharge of any fireworks, firearm, air gun, archery device, slingshot, or explosive of any kind is prohibited, except as provided for in the California Penal Code, Sections 12031 and 12050. FIRE. To build, light, kindle, or maintain a fire in any place other than areas or facilities specifically built and designated by the City, or to leave any fire unattended, throw away any lighted tobacco pro- duct, any burning or combustible material, or other matter that could cause a fire hazard is prohibited. Charcoal cooking fires may be main- tained in portable barbecues or camp stoves approved by the employee on duty. To avoid being a fire hazard coals must be extinguished and placed in a fire ring after use. VEHICLE USE AND PARKING. Operation of an automobile, bicycle, truck, trailer or vehicle of any description other than upon designated open and paved roads or in other than designated parking areas is prohi- bited. Vehicles of any description shall not be operated at a speed greater than ten {10) miles per hour. REMOVAL/DEFACEMENT OF PROPERTY. To move any trash receptacle or other City property from where it was placed by the City is prohibited. No one shall in any way deface or mutilate any tree, fence, wall, building, railing, playground, or playground equipment, picnic struc- ture, monument of any other fixture or improvement. Removing a "reserved" sign or willfully occupying and holding a camp site, building or facility which has been reserved and for which a valid per- mit has been issued, is not permitted. Users or permittee will be per- sonally responsible for all damage to the building, and shall be responsible for reimbursing the City for any loss or damage to City property, caused by such use. ANIMALS. Dogs are prohibited in the developed areas. All dogs are to be securely leashed at all times by a chain or rope, not more than six (6) feet in length in undeveloped areas. No dogs, horses, or other animals are allowed within one hundred {100} feet of Lake Poway. Horses and other hoofed animals shall not be allowed, maintained, ridden, lead or hitched other than upon roads, trails and areas specifically posted for equestrian activity. Controlled and supervised animal shows may be allowed with prior written approval of the Director of Community Services. GATHERING WOOD. Gathering wood from natural or landscaped vegetation for any purpose including fires is prohibited. Atachment 2 5.9 5.10 5.11 5.12 5.13 5.14 5.15 5.16 5.17 Resolution No. 88-133 Page 13 CURFEW. No one shall violate curfew hours as established at the following locations: Lake Poway - as posted at the entrance and at the permit office. Con~nunity Park - as posted at the Community Park office. Garden Road Park - sunrise to sunset. LEAVING. Entering any portion of the recreation area not a camping area, is not permitted after closing (park siren designates closing hour). All groups are expected to leave the premises in the same con- dition in which they were found. The kitchen facilities must be left clean and all utensils washed and put away. CLOSED AREAS. No one shall enter any posted restricted or closed area. PEACE AND QUIET. No one shall disturb the peace and quiet by any loud or unusal noise, or by the sounding of automobile horns or noise-making devices, or by the use of profane, obscene or abusive language or gestures. Operation of musical equipment or instruments and/or electronic sound reproduction equipment including television, radio and tape deck in excess of the noise standards established by Section 36.401 - 36.433 of the City of Poway Regulatory Ordinance is not permitted. ENTERTAINMENT. No one shall setup or maintain any exhibition, show performance, concert, place of amusement, lecture, oration or concert hall without permission to do so from the City Council. SOLICITING, SELLING AND ADVERTISING. No 'one shall vend, offer for sale, or dispose of any goods, wares or merchandise, or conduct any business unless authorized to do so in writing by the City Manager, or distribute, circulate, give away or throw or deposit any hand bills, circulars, pamphlets, tracts, dodgers or advertisements, or post, or affix to any tree, fence or structure any such hand bill, circular, pamphlet, tract, dodger, or advertisement, unless authorized to do so in writing by the City Manager. DECORATIONS. Users must comply with the Health and Safety Code per- taining to the flameproofing of all decorations. Decorations will be permitted only upon approval, in writing, of the Director of Co.m,unity Services. All decorations must be removed upon the conclusion of the event. Users or permittees will be personally responsible for all damages to the building or appurtenances thereof and.shall be respon- sible for reimbursing the City for any loss or damage to City property by such use. WASTE WATER. No one shall dump any waste water, including dishwater, any place other than into toilets at designated restroom facilities or as directed by the employee on duty. HUMAN WASTE - TOILETS. No person shall deposit or cause to be depo- sited human wastes within the recreation area other than in designated sanitary facilities. Possession of a valid lake use permit is required of every person using Lake Poway who possesses any fishing gear or occupies a boat containing any fishing gear. No permit shall be issued to any one age 7 years or younger unless accompanied by a person of age 16 or older possessing a valid permit. STATE LICENSE/LAWS. All persons fishing in Lake Poway shall have a valid State of California fishing license, shall not possess fish in excess of posted limits and shall observe all state fish and game laws and regulations. CATCHES BY CHILDREN. The catches of any child age 7 years or younger shall apply to the limit of the accompanying adult. NO FISHING AREAS. No person shall fish from or within 100 feet of any boat ramp, boat float, buoy, or other floating structure other than a designated fishing float or from or within any other posted area. CATCH LIMITATION. No large mouth bass under 12 inches in total length shall be taken from Lake Poway. SWIMMING. No person shall swim, wade {with or without waders or hip boots), bathe, wash, clean fish, clean any article or make any other direct human contact with the waters of Lake Poway or engage in any activity which may tend to cause pollution. CLEANING. No person shall deposit or cause to be deposited, food scraps, fish remains, paper, bottles, cans or any other waste material, organic or inorganic, into the water or along the shoreline of Lake Poway, or within the recreation area other than designated receptacles. Cleaning fish at other than designated facilities is prohibited. PERMITS. Possession of a valid boat permit is required for each boat on Lake Poway. A permit shall not be issued to any person under age 16 without a City issued boating safety card. Full day permits will be issued before noon on fishing days. Half day permits will non be issued until noon on fishing days. PRIVATE BOATS/GASOLINE MOTORS. The use of any type of private boat or private gasoline motors on Lake Poway is prohibited. SAFETY. No boat shall be operated on Lake Poway: a. unless occupied by at least one responsible person age 16 years or older, or a holder of a City issued boating safety card; b. with more passengers than its assigned capacity; c. within lOOfeet of any fishing float; d. within any area as posted; and e. in an unsafe manner. Attachment 2 Resolution No. 884 33 Page 15 I~LASSIFI~TI~ OF APPLICANTS ~ FEES Each application will be reviewed by the Recreation Supervisor and classified into a group depending on the type of organization and the intended use. City of Poway and CoE)w~)unity Services Department activities have first priority for the use of the facilities. The classifications are listed in order of priority with classification "A" first, classification "B" second, and so on. The City attempts to accommodate all groups, however, there are a limited number of facilities. Unfortunately, the demand exceeds the supply, and for that reason, a priority system for use has been established. Public agencies. Community Services Department sponsored and co- sponsored activities, City of Poway, Poway Unified School District. Examples: City meetings, school district awards banquets, Poway Valley Senior Citizens, Inc. classes. Service organizations, {residents only), all service and social organi- zations based in Poway with a membership of 51 percent residents. Acceptable as either a fund-raising or nonprofit activity. Examples: Poway Rotary, Poway Lions Club, Poway Toastmasters, Scout Troup. Nonprofit groups (residents only), youth organizations, sports groups, special interest clubs for general meetings, and nonprofit programs with a membership of 51 percent residents.
