A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ORDERING THE SUMMARY VACATION OF
A DRAINAGE EASEMENT WITHIN: LOT 27 OF HERITAGE HILLTOP
ACCORDING TO THE MAP THEREOF NO. 7432 RECORDED
IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO
COUNTY AS FILE NO. 244580 ON SEPTEMBER 13, 1972

WHEREAS, the City Council of the City of Poway desires to summarily vacate
a certain public service easement in accordance with the procedures provided in
Chapter 4, Part 3, Division g of the Streets and Highways Code of the State of
California, commencing at Section 8330; and
WHEREAS, a drainage easement within the attached legal description titled
"Exhibit A" was dedicated to the City per Map 7432 known as Heritage Hilltop
recorded as File No. 244580 on September 13, 1972 in the Office of the County
Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:

This summary vacation is made under the provisions of Chapter 4, Part
3, Division 9 of the Streets and Highways Code of the State of
California.
The City Council hereby finds that the herein described public service
easement has been superseded by relocation and there are no other
public facilities located within the easement.
The City Council hereby declares that the following described drainage
easement is hereby vacated:
See attached legal description titled "Exhibit A."
4. The City Clerk of the City of Poway is hereby directed to cause a cer-
tified copy of this resolution to be recorded in the office of the
Recorder of San Diego County in accordance with the provisions of
Section 8336 of the Streets and Highways Code.

That portion of an existing drainage easement in Lot 27 of Heritage Hilltop
according to the Hap thereof No. 7432, recorded in the Office of the County
Recorder of San Diego County on September 13, 1972, being more particularly
described as follows:
Beginning at the Northwesterly corner of Lot 23 of said Heritage Hilltop per
said Map No. 7432, thence North 37032'32'' West, 277.46 feet along the centerline
of said drainage easement to the TRUE POINT OF BEGINNING, said easement being
10' wide, 5.00' left and right of said centerline, thence continuing along the
centerline of said easement North 37032'32'' West, 142.04 feet to the beginning
of a tangent curve concave to the Southwest having a radius of 50.00 feet,
thence Northwesterly along said curve through an arc length of 39.23 feet and a
central angle of 44057'28'' to a point of tangency, said point being the radial
extension of the sidelines of said drainage easement to 15.00 feet on each side
of said centerline, thence North 82030'00'' West, 38.76 feet to the point of ter-
minus, said point being on the westerly boundary of said Lot 27 and being the
westerly boundary of said Heritage Hilltop, the sidelines of said drainage ease-
ment terminating at said westerly boundary.
