Res 89-026RESOLUTION NO. 89-026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING LANDSCAPE MAINTENANCE DISTRICT POLICIES AND PROCEDURES WHEREAS, the Landscaping and Lighting Act of 1972 provides cities authoriza- tion to assess property owners for landscape improvements; and WHEREAS, the above cited act requires that the assessment levied must be in proportion to the estimated benefit to be received from each lot from the impro- vements; and WHEREAS, in order to comply with the Landscaping and Lighting Act of 1972 it is necessary to implement specific policies and procedures. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Poway does hereby approve in concept the Landscape Maintenance District boundaries as shown on Exhibit A subject to annexations in conformance with State law. AND BE IT FURTHER RESOLVED that the City Council approve the Landscape Maintenance District Policies and Procedures as shown on Exhibit B. Assess at a 50 percent rate those subdivisions and lot splits that do not contain landscape maintenance district improvements in the developments and that are not immediately adjacent to or receive access through developments that contain improvements maintained by a landscape maintenance district. Annex in all new industrial, commercial, apartments, and mobile home park developments that have improvements in areas that are maintained by a landscape maintenance district. Exhibit B
