Res 89-063Resolution No. 89-063 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, STATE OF CALIFORNIA, DECLARING THE INTENTION TO LEVY AND COLLECT ASSESSMENTS WITH THE POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 83-1 FOR FISCAL YEAR 1989-90 WHEREAS, the City Council of the City of Poway desires to levy and collect assessments within Poway Landscape Maintenance Assessment District 83-1 for the purpose of maintaining, servicing, and operating public landscape facilities located within the territory comprising of said district as shown in Exhibit "A" pursuant to the Landscape and Lighting Act of 1972; and WHEREAS, the public interest and convenience requires the maintenance, ser- vice and operation of public landscaping, soundwalls, recreational trails, and future parks within said territory. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: 1. The foregoing recitals are true and correct and the City Council so finds and determines. Proposed assessments for 1989-90 are as detailed in the Engineer's Report for Poway Landscape Maintenance Assessment District No. 86-1 for fiscal year lgsg-go {Exhibit "A"}. e Pursuant to the Streets and Highways Code, a public hearing will be held on June 6, 1989 in the City Council Chambers at City Hall to consider the levy and collection of the proposed assessments. The assessment district was formed May 20, 1986 as a means of financing the maintenance of landscape improvements installed in conjunction with new subdivisions in Poway, the boundary being as shown in Exhibit "A". FI#OIl, S The Landscape and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvements which include the facilities existing within the subject assessment district. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section- 22573 provides that: The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." Based upon the foregoing, it is proposed that the City of Poway generate the necessary revenue required to maintain the aforemention landscaping improvements with Poway Landscape Maintenance Assessment District No. 83-1 for the 1989-90 fiscal year using the method provided for in the Landscape and Lighting Act of 1972. EI~IHEEItlI4(~ Boundary The boundary of the proposed assessment district is as shown on Exhibit "A" with Rancho Arbolitos subdivision being the major portion of the district with 953 lots. The other component subdivisions presently making up the district are Adobe Ridge I and II {formerly Poway Woods 1 and 2), the Colonies {formerly Poway Hills), Casa Real Unit 7, Rancho Espola, Twin Peaks Plaza, Country Creek, Woodland Hills, Con~nunity 16 Villas, and Park Village Condos. Exceptions from the assessment of said costs and expenses within the area described are: all public streets, public avenues, public lanes, public roads, public drives, public courts, public alleys, all easements and right-of-way, all public parks, greenbelts and parkways, and all public school property being used for public school purposes. The name of the district is: "Poway Landscape Maintenance Assessment District No. 83-1." EXHIBIT A Engineer's Report, LND 83-1 Page 2 Resolution No. 89-063 Page 4 FAClLITIE~ The facilities to be maintained are deflned as the landscaping and soundwalls wlthln the right-of-way and adjacent to'Camino del Norte, Twtn Peaks Road, Route 56 and Espola Road; the recreational trails, sidewalks, and greenbelts within the dlstrlct boundaries, and 25% of the maintenance costs of Starrldge Park and all future parks within the District. EXISTII~ CONOITItX~ OF LANDSCAPE NAINTEI4J~CE WITH DEVELOPED SUBDIVI$IIX~ OF OISTRICT A general assessment of the present level and quality of landscape maintenance within subdivisions of the District having improved landscape development within public right-of-way, has been recently conducted. Landscape maintenance and performance standards and specifications have been developed to assure a con- tinuing level of quality to landscape careof assessment district properties. L'(}I41~IAL PROPERTIES N~EXED INTO THE OISTRICT Twin Peaks Plaza has been included into the District. An equivalent dwelling unit of 88 has been assigned to this con~nercial development. A potential exists for the need to provide a differential assessment to con~ner- cial properties within the District. City staff is currently working with the respective owners of such properties to establish master landscape development criteria to develop a general landscape development plan, specific to the com- mercial core, that will provide continuity to overall landscape design in the District, and allow for the establishment of an equitable differential assessment. BENEFIT NL~L~I$ The District is made up of the following subdivisions: Adobe Ridge Unit 1, 55 units; Adobe Ridge Unit 2, 57 units {formerly Poway Woods); Casa Real Unit 7, 69 units; The Colonies of Poway, 30 units {formerly Poway Hills); Rancho Arbolitos, 953 units; Rancho Espola, 12 units; Twin Peaks Plaza, 88 units; Country Creek, 51 units; Woodland Hills, 28 units; Park Village, 18 units; and Con~nunity 16 Villas, 16 units, for a total of 1,392 units. The assessments will be calcu- lated on a per unit basis by dividing the required revenue by 1,392.
