A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, DECLARING THE INTENTION TO LEVY
AND COLLECT ASSESSMENTS W[TH THE POWAY
LANDSCAPE MAZNTENANCE ASSESSMENT DZSTRZCT NO. 86-2
FOR FISCAL YEAR 1989-90
WHEREAS, the City Counc11 of the Clty of Poway desires to levy and collect
assessments wlthln Poway Landscape Maintenance Assessment Olstrtct 86-2 for the
purpose of malntaining, servicing, and operating public landscape facilities
located within the territory comprising of said district as shown In Exhlblt "A"
pursuant to the Landscape and Ltghting Act of 1972; and
WHEREAS, the public Interest and convenience requires the maintenance, ser-
vice and operation of publlc landscaping, soundwalls, recreational tratls, and
future parks wlthln said territory.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
1. The foregoing recitals are true and correct and the City Council so
finds and determines.

Proposed assessments for 1989-90 are as detailed in the Engineer's
Report for Poway Landscape Maintenance Assessment District No. 86-2 for
fiscal year 1989-90 {Exhibit "A").

Pursuant to the Streets and Highways Code, a public hearing will be held
on June 6, 1989 in the City Council Chambers at City Hall to consider
the levy and collection of the proposed assessments.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this ~ay of May, 1989.

The purpose of thts report ls to set forth the findings and engineering analysls
for Poway Landscape Maintenance Assessment District No. 86-2 for 1989-1990
flscal year. The assessment dlstrlct was formed Nay 20, 1986 as a means of
financing the maintenance of landscape improvements installed In conjunction
with new subdivisions in Poway, the boundary being as shown in Exhlbit "A".
The Landscape and Llghtlng Act of 1972 permits the establishment of assessment
districts by clttes for the purpose of providing for the maintenance of certain
public improvements which include the facilities exlstlng within the subject
assessment district. The 1972 Act requires that maintenance assessments be
levied according to benefit rather than according to estimated value. Section
22573 provides that:
The net amount to be assessed upon lands within an assessment
district may be apportioned by any formula or method which
fairly distributes the net amount among all assessable lots or
parcels in proportion to the estimated benefit to be received
by each such lot or parcel from the improvements."
Based upon the foregoing, it is proposed that the City of Poway generate the
necessary revenue required to maintain the aforemention landscaping improvements
with Poway Landscape Maintenance Assessment District No. 86-2 for the 1989-90
fiscal year using the method provided for in the Landscape and Lighting Act of
1972.
ENGINEERII~ ANALYSIS
Boundary
The boundary of the proposed assessment district is as shown on Exhibit "A" with
City of Poway Tract 4185R, 83-02, and 87-12, being the present full extent of
the district {231 units).
Exceptions from the assessment of said costs and expenses within the area
described are: all public streets, public avenues, public lanes, public roads,
public drives, public courts, public alleys, all easements and right-of-way, all
public parks, greenbelts and parkways, and all public school property being used
for public school purposes.
The name of the district is: "Poway Landscape Maintenance Assessment District
No. 86-2."

FACILITIES
The facilities to be maintained are defined as the landscaping and soundwalls
within the right-of-way and adjacent to Poway Road and Garden Road, the
recreational trails, sidewalks, and greenbelts within the district boundarles.
BENEFIT AIIALY$I$
The District is made up of 35 residential units in Sunrise Ranch, Tract 4185R,
and 164 residential units in Sycamore Creek, Tract 83-02, and 30 residential
units in Poway Villas, Tract 87-12. The assessment will be calculated on a per
unit basis by dividing the required revenue by 229.
