A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AUTHORIZING EXONERATION OF PERMIT BONDS BY STAFF
WHEREAS, bonds and other forms of security posted by project developers to
guarantee payment to the City of development fees (hereinafter, "permit bonds")
do not require discretionary determination by the City Council that a project
has been completed before such payment bonds may be exonerated; and
WHEREAS, the City Manager or his designee may be authorized to exonerate
permit bonds upon an administrative determination that all development fees have
been paid.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF POWAY AS
FOLLOWS:
That the City Manager or his designee is hereby authorized to exonerate
permit bonds upon administrative determination that all development fees
secured by such bonds have been paid; and
2. That such determination and exoneration may be made by staff without
further City Council approval.
