Res 89-080Resolution No. 89-080 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, RESCINDING RESOLUTION NO. 89-064 AND DECLARING THE INTENTION TO LEVY AND COLLECT ASSESSMENTS WITH THE POWAY LANDSCAPE ASSESSMENT DISTRICT NO. 86-1 FOR FISCAL YEAR 1989-90 WHEREAS, the City Council fo the City of Poway desires to levy and collect assessments within Poway Landscape Maintenance Assessment District 86-1 for the purpose of maintaining, servicing, and operating public landscape facilities located within the territory comprising of said district as shown in Exhibit "A" pursuant to the Landscape and Lighting Act of 1972; and WHEREAS, the public interest and convenience requires the maintenance, service and operation of public landscaping, soundwalls, recreational trails, and future parks within said territory. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: 1. 2. Resolution No. 89-064 is hereby rescinded. The foregoing recitals are true and correct and the City Council so finds and determines. Proposed assessments for 1989-90 are as detailed in the Engineer's Report for Poway Landscape Maintenance District No. 86-1 for fiscal year 1989-90. Pursuant to the Streets and Highways Code, a public hearing will be held on June 27, 1989 in the City Council Chan~3ers at City Hall to consider the levy and collection of the Proposed assessments. W Wahlsten, City Clerk City of P~ay ENGZHEER~$ REPORT Resolution No. 89-080 Page 3 POIMY LANDSCAPE MAINTENANCE A~E~ DISTRICT NO, 86-1 FOR 1989-90 FZ,TCAL YEAR PURI~E The purpose of this report is to set forth the findings and engineering analysis for Poway Landscape Maintenance Assessment District No. 86-1 for 1989-1990 fiscal year. The assessment district was formed June 12, 1986 as a means of financing the maintenance of landscape improvements installed in conjunctlon with new subdivisions in Poway, the boundaries being as shown in Exhibit "A". The Landscape and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvements which include the facilities existing within the subject assessment district. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." Based upon the foregoing, it is proposed that the City of Poway generate the necessary revenue required to maintain the aforemention landscaping improvements with Poway Landscape Maintenance Assessment District No. 86-1 for the 1989-90 fiscal year using the method provided for in the Landscape and Lighting Act of 1972. EI~INEERII~ ANALYSIS Boundary The boundaries of the proposed assessment district is as shown on Exhibit "A" with City of Poway Tract 4090R, 4091R, 4092R, 4093R, 4158, 84-08, 86-01, 3545, 88-02, and 87-05 being the present full extent of the district {664 units}. Thirty-nine additional units from TM 88-01 have been annexed into LMD 86-01 on May 29, 1989. These units are included in this report. Exceptions from the assessment of said costs and expenses within the area described are: all public streets, public avenues, public lanes, public roads, public drives, public courts, public alleys, all easements and right-of-way, all public parks, greenbelts and parkways, and all public school property being used for public school purposes. Page 2 Resolution No. 89-080 Page 4 FACILITIES The facilities to be maintained are deflned as the landscaping and soundwalls within the right-of-way and adjacent to Poway Road and Garden Road, the recreational trails, sidewalks, and greenbelts within the district boundaries. Landscape main- tenance and performance standards and specifications have been developed to assure a continuing level of quality to landscape care of assessment district properties. The District encompasses eight tract developments along the Espola Road corri- dor. Tracts 4090R to 4093R have an aggregate total of 415 units while TM 3545 has 78 units, TM 4158 has 21 units, TM 84-08 has 73 units, TM 86-01 has 71 units, TPM 87-05 has 4 units, and TPM 88-02 has 2 units. The total number of units within the District is 664. The assessment will be calculated on a per unit basis by dividing the required revenue by 664.
