A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING AN AMENDMENT TO THE LAND USE ELEMENT PLAN
OF THE GENERAL PLAN OF THE POWAY COMPREHENSIVE PLAN
GENERAL PLAN ~IENDMENT (GPA 89-02A)
WHEREAS, the City Council of the City of Poway recognizes that the need may
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code describes
the procedures for amending General Plans; and
WHEREAS, Elvira Zupon, applicant and trustee for the Haley Trailer Ranch,
and Richard Kuebler, co-applicant, have filed an application for General Plan
Amendment/Zone Change 89-02A requesting an amendment to the Land Use Element
Plan and a corresponding amendment to the Poway Zoning Development Plan for
Assessor's Parcel Number 317-480-11, consisting of 35.06 acres and located at
the southeast corner of the intersection of Poway and Community Roads; and
WHEREAS, the subject parcel is bisected in its northerly one-half by Poway
Creek in an east to west direction; and the parcel area located north of Poway
Creek is currently designated Community Commercial in its approximate western
one-half, and is designated Residential Mobile Home Park(8 du/net acre) in its
approximate eastern one-half; and the parcel area located south of Poway Creek is
currently designated Residential Single-Family i (1 du/net acre); and
WHEREAS, the application requests that the parcel area located north of
Poway Creek be redesignated from Community Commercial and Residential Mobile
Home Park (8 du/net acre) to Community Commercial in its entirety; and that the
parcel area located south of Poway Creek be redesignated from Residential
Single-Family i (1 du/net acre) to Residential Mobile Home Park (8 du/net acre)
in its entirety; and
WHEREAS, on June 13, 1989, the City of Poway held a properly noticed public
hearing in accordance with the California Government Code and the California
Environmental Quality Act to consider the Final Environmental Impact Report
(EIR) prepared for the Haley Trust Properties Project, and said project involves
General Plan Amendment/Zone Change 89-02A; and
WHEREAS, pursuant to recently enacted State legislation (AB 3180), a
Mitigation Monitoring/Reporting Program has been prepared to ensure the success-
ful implementation of all mitigation measures identified in the Final EIR, and
said program is contained in the Final EIR; and
WHEREAS, at said public hearing, the City Council adopted a resolution cer-
tifying that:
The subject Final EIR for the aforementioned project application has
been prepared and completed in compliance with the California
Environmental Quality Act and the City of Poway Procedures for
Implementing CEQA; and

The subject Final EIR for the aforementioned project application was
presented to the City Council who reviewed and considered the infor-
mation contained in that document including the response to public com-
ment, and considered all testimony received at the public hearing prior
to approving the project application; and
e
The City Council finds that the subject environmental document is
complete and adequately addresses the environmental impacts of the pro-
posed General Plan Amendment 89-02A and Zone Change 89-02A applica-
tions.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve, by
adoption of this resolution, an amendment to the Land Use Element Plan of the
General Plan described herein as General Plan Amendment (GPA 89-02A).
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 13th day of June, 1989.
