AN AGREEMENT BETWEEN THE COUNTY OF SAN DIEGO
CITY OFPOWAY AND THE CITY OF POWAY FOR THE COLLECTION OF
CITY CLERKS OFFICE THE PLEASURE RIDING TAX
THIS AGREEMENT made on this 20th day of April

1982 , by and between the County of San Diego, a
political subdivision (hereinafter referred to as County),
and the City of Poway, a municipal corporation (hereinafter
referred to as City).
WITNESSETH:
WHEREAS, the Pleasure Riding Tax Law (Article 14 [commencing
with Section 53940] of Chapter 4, Part 1, Division 2, Title
5 of the Government Code) was enacted to provide for the
acquisition and development of further public areas, including
public riding and hiking trails, by a tax on those persons
who receive special benefit from such public areas; and
WHEREAS, the County has enacted a Pleasure Riding Trail
Tax (Chapter 1, Division 4 [commencing with Section 24.1011
of the County Code of Regulatory Ordinances); and
WHEREAS, the City wishes to collect such tax for the
County within the City's boundaries. NOW, THEREFORE,
The County and the City mutually agree as follows:
1. The City shall be responsible for the collection of
the Pleasure Riding Trail Tax within its boundaries.
2. The City shall deposit all monies collected from
said tax with the County Treasurer on a monthly basis.

3. The City shall comply with the provisions of
Chapter 1, Division 4 (commencing with Section 24.101) of
the County Code of Regulatory Ordinances.
4. The City shall indemnify, save, defend and hold
harmless the County from any and all acts, claims, omissions
and actions resulting from the City's performance of the
provisions of this agreement.
5. County shall reimburse City for the reasonable
expenses incurred by City in collecting the tax from monies
deposited with the County Treasurer by the City. City shall
submit written requests for reimbursement to the County on a
monthly basis.
6. County shall allow the City to use monies deposited
with the County Treasurer for those purposes specified in
Section 24.113 of the County Code of Regulatory Ordinances
and not otherwise referenced in paragraph 5 of this agreement.
This shall be done by a written request of the City to the
County.
IN WITNESS WHEREOF, the parties hereto have set their
hands on the date first written above.
