A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING THE RECORDATION OF A NOTICE OF VIOLATION FOR
ASSESSOR'S PARCEL NUMBERS 277-130 02 AND 277-010-16
WHEREAS, a Notice of Intention to Record a Notice of Violation of the
Subdivision Map Act has been initiated on APN 277-130-02, 6.9 acres along Old
Coach Road (John W. Bernhard) and APN 277-010-16, 4.97 acres at 18118 Old Coach
Road; (Gene and Judith Purvis); and
WHEREAS, on May 16, 1989, and on June 27, 1989, the City Council held a
hearing and determined that said parcels were created by Quitclaim Deed in
violation of the Subdivision Map Act and Title 16 of the Poway Municipal Code in
that no parcel map to effect such subdivision was approved by either the County
of San Die§o or the City of Poway.
NOW, THEREFORE, the City Council does hereby resolve as follows:
That pursuant to Government Code Section 66499.36 a Notice of Violation in
the form attached to this resolution be recorded in the Office of the
Recorder of the County of San Diego, finding and declaring that APN
277-130-02 and APN 277-010-16 were illegally divided by Quitclaim Deed
signed January 3, 1978 and recorded December 1, 1981, as Document No.
81-377473.
APPROVED and ADOPTED by the City Council ofx~the City of Poway, State of
California, this 27th day of June, 1989.
