A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ORDERING THE SUMMARY VACATION OF
A DRAINAGE EASEMENT WITHIN: LOT 312 OF CITY OF POWAY
TRACT NO. 4191-4R ACCORDING TO THE MAP THEREOF NO. 12770
RECORDED IN THE OFFICE OF THE COUNTY RECORDER OF
SAN DIEGO COUNTY AS FILE NO. 88-612469 ON NOVEMBER 30, 1988
(Vacation 89-07)
WHEREAS, the City Council of the City of Poway desires to summarily vacate
a certain public service easement in accordance with the procedures provided in
Chapter 4, Part 3, Division g of the Streets and Highways Code of the State of
California, commencing at Section 8330; and
WHEREAS, a drainage easement within the attached legal description titled
"Exhibit A" was dedicated to the City per Map 12270 known as City of Poway Tract
No. 4191-4R recorded as File No. 88-612489 on November 30, 1988 in the Office of
the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:

This summary vacation is made under the provisions of Chapter 4, Part
3, Division 9 of the Streets and Highways Code of the State of
California.

The City Council hereby finds that the herein described public service
easement has been superseded by relocation and there are no other
public facilities located within the easement.
The City Council hereby declares that the following described drainage
easement is hereby vacated:
See attached legal description titled "Exhibit A."
The City Clerk of the City of Poway is hereby directed to cause a cer-
tified copy of this resolution to be recorded in the office of the
Recorder of San Diego County in accordance with the provisions of
Section 8336 of the Streets and Highways Code.

All that portion the existing 20 foot wide storm drain easement in Lot 312, of City of
Poway Tract No.4191-4R, according to map thereof No.12270, recorded in the office of
the County Recorder, of San Diego County, State of California, being more particularly
described as follows:
Beginning at the southwest corner of said Lot 312; thence North 89°13'14" East, 60.62
feet along the South line of said Lot 312 to the TRUE POINT OF BEGINNING; thence North
26o45'00" East, 27.37 feet; thence North 20o30'25" West, 59.57 feet; thence North
26o45'00" East, 27.23 feet; thence South 20°30'25" East, 86.81 feet; thence South
26045'00.. West, 25.69 feet to said South line of Lot 312; thence South 89°13'14.'
West, 22.55 feet along said South line to the TRUE POINT OF BEGINNING.
