A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ORDERING THE SUMMARY VACATION OF
AN IRREVOCABLE OFFER OF DEDICATION WITHIN:
PARCELS 1 AND 2 OF PARCEL MAP NO. 10823 AS FILED
IN THE OFFICE OF THE COUNTY RECORDER ON DECEMBER 18, 1980
(Vacation 89-06)
WHEREAS, the City Council of the City of Poway desires to summarily vacate a
certain public service easement in accordance with the procedures provided in
Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State of
California, commencing at Section 8330; and
WHEREAS, an irrevocable offer of dedication within Parcels 1 and 2 of Parcel
Map 10823, in the City of Poway, County of San Diego, State of California, filed
in the Office of the County Recorder of San Diego County on December 18, 1980,
was dedicated to the City per a document recorded as Document No. 89-142006 on
March 21, 1989 in the Office of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
This summary vacation is made under the provisions of Chapter 4, Part
3, Division 9 of the Streets and Highways Code of the State of
California.

The City Council hereby finds that the herein described irrevocable
offer of dedication is excess street right-of-way not required for
street purposes.
3. The City Council hereby declares that the following described irrevo-
cable offer of dedication is hereby vacated:
See attached legal description titled "Exhibit A."

The City Clerk of the City of Poway is hereby directed to cause a cer-
tified copy of this resolution to be recorded in the office of the
Recorder of San Diego County in accordance with the provisions of
Section 8336 of the Streets and Highways Code.

Those portions of Parcel i and Parcel 2 of Parcel Map No. 10823, in the City of
Poway, County of San Diego, State of California, filed in the office of the
County Recorder of San Diego County on December 18, 1980 and more particularly
described as follows:
Commencing at the Northwest corner of Parcel 1 of Parcel Map No. 10823; thence
South 88°42'48'' East along the Northerly boundary of said Parcel Map 47.39 feet
to the TRUE POINT OF BEGINNING; thence continuing along said boundary, South
88°42'48'' East, a distance of 134.98 feet to a point on the arc of a non-tangent
270.00 foot radius curve concave Southeasterly, a radial line to said point
bears North 12°50'03'' West (North 12°49'41'' West per Map No. 8457); thence
leaving said Northerly line and going Southwesterly along the arc of said curve
through a central angle of 00°58'40'', a distance of 4.61 feet to a point on the
arc of a 99.00 foot radius curve concave Southeasterly, a radial line to said
point bears North 13°48'43'' West; thence Southwesterly along the arc of said
curve through a central angle of 55°13'30'', a distance of 95.42 feet to a point
of a reverse 48.00 foot radius curve concave Northeasterly; thence Southwesterly,
Westerly, and Northeasterly along the arc of said curve through a central angle
of 209052'23'', a distance of 175.82 feet to a point on the arc of a 330.00 foot
radius curve, concave Southeasterly, a radial line to said point bears North
39°09'50'' West; thence Northeasterly along the arc of said curve through a
