A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNZA, ORDERING THE SUNNARY VACATION OF
A SEWER EASENENT WZTHZN LOT 234 OF COUNTY OF SAN DZEGO
TRACT 3461-7 RECORDED AS NAP NO. 8885 [N THE OFF[CE
OF THE COUNTY RECORDER ON JUNE 7, 1978
UNDER FILE NO. 78-235448

WHEREAS, the City Council of the City of Poway desires to summarily vacate
certain public service easements in accordance with the procedures provided in
Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State of
California, commencing at Section 8330; and
WHEREAS, a sewer easement within Lot 234 of County of San Diego Tract 3461-7
recorded as Map No. 8885 in the office of the County Recorder under File
78-235448 were dedicated to the City of Poway per a document recorded as
File/Page 80-017420 in Book 1980 on January 16, 1980.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
This summary vacation is made under the provisions of Chapter 4, Part
3, Division 9 of the Streets and Highways Code of the State of
California.

The City Council hereby finds that the herein described public service
easements for water have have been superseded by relocation and there
are no other public facilities located within the easement.
The City Council hereby declares that the following described sewer
easement is hereby vacated:
See attached legal description titled "Exhibit A.m'
The City Clerk of the City of Poway is hereby directed to cause a cer-
tified copy of this resolution to be recorded in the office of the
Recorder of San Diego County in accordance with the provisions of
Section 8336 of the Streets and Highways Code.
