A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING THE SALE OF CERTAIN REAL PROPERTY
TO THE POWAY REDEVELOPMENT AGENCY
PURSUANT TO A PURCHASE AND SALE AGREEMENT
BY AND BETWEEN THE CITY OF POWAY
AND THE POWAY REDEVELOPMENT AGENCY
WHEREAS, the Poway Redevelopment Agency ("Agency") is authorized to conduct
redevelopment activities within the Paguay Project Area ("Project Area"), which
activities include the acquisition and subdivision of real property for public
purposes consistent with the Redevelopment Plan; and
WHEREAS, the Agency desires to enter into a Purchase and Sale Agreement
("Agreement") by and between the City of Poway and the Redevelopment Agency; and
WHEREAS, the City desires to sell to the Redevelopment Agency that property
more particularly described in the Agreement for subdivision in accordance with
the Redevelopment Plan; and
WHEREAS, a copy of the Purchase and Sale Agreement and the summary setting
forth the particulars have been made available for public inspection and
copying.
NOW, THEREFORE, the City Council of the City of Poway does hereby resolve as
follows:
Section 1: The City Council finds and deteFmines, based upon the testimony
and information presented, that the consideration for the real property to be
conveyed to the Agency, is equal to the fair market value thereof.
Section 2: The City Council directs the Mayor to (1) execute the Grant Deed
conveying to the Agency the parcel described in the Agreement, and (2) execute
the Purchase and Sale Agreement.
